Acquisition of property located north of Major Mackenzie Drive and west
of Bathurst Street, in the City of Vaughan, Regional Municipality of York,
under the "Greenspace Acquisition Project for 2021-2030," Flood Plain
and Conservation Component, Don River watershed (CFN 56778).

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 9.44 hectares (23.33 acres), more or
less, of vacant land, located north of Major Mackenzie Drive and west of Bathurst Street,
said land being Part of Lots 21 and 22, Concession 2, designated as Blocks 402-404
(inclusive), 65M-4425, Blocks 283 and 288, Plan 65M-4491 and Blocks 14 and 15, Plan
65M-4532; and an access easement on Part 1, Plan 65R-36700, in the City of Vaughan,
Regional Municipality of York, be purchased from Longyard Properties Inc.;
THAT the purchase price be $2.00;
THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the
land free from encumbrance, subject to existing service easements;
THAT the transaction be completed at the earliest possible date and that all reasonable

BACKGROUND
Resolution #A28/20 at Board of Directors Meeting #3/20, held on April 24, 2020, approved the
Greenspace Acquisition Project for 2021-2030.
Negotiations have been conducted with Madison Vanderveen, Project Coordinator of DG
Group, acting as agent for the owners.
Access to the subject lands will be achieved through its frontage onto Major Mackenzie Drive
and from an access easement off Fanning Mills Circle (Part 1, Plan 65R-36700).
Attachment 1 is a sketch illustrating the location of the subject lands. Attachment 2 is an
orthophoto illustrating the location of the subject lands.
RATIONALE
The subject lands fall within TRCA's plan for acquisition as outlined in the approved
Greenspace Acquisition Project for 2021-2030. The lands were identified for conveyance to
TRCA through the review of subdivision applications, as well as work conducted for the
Redelmeier Pond restoration project.
The subject lands contained the Redelmeier Pond restoration site located in the headwaters of
the East Don River. The approximate size of Redelmeier Pond was 2.91 ha with an approximate
perimeter of 1,300 m. The pond was created as a mill pond in the late 1800's, with the original
mill race being destroyed by Hurricane Hazel in 1954, but then being rebuilt shortly after. The
current dam and pond configuration has remained relatively consistent for the last 50-60 years.
The open water condition of Redelmeier Pond was maintained by an 80m earth berm and
control structure, located near the southeast corner of the pond. The water control structure of
Redelmeier Pond previously delineated the upstream limit of Occupied Redside Dace (RSD)
habitat, which is regulated by Ministry of the Environment, Conservation and Parks (MECP).
Since 2016, TRCA had been monitoring the existing water control structure and earth berm at
Redelmeier Pond. In March 2017 rising water levels due to obstructions were noted at the failed
water control structure, contributing to an increased risk of water overtopping the berm, and
further failure of the berm and structure. To address the immediate risk associated with the
dam and pond, TRCA removed the debris blockage and sluiceway stop logs to increase
available freeboard and reduce the pressure gradient at the berm.
By July 2017, trees were observed toppling from the berm into the valley, along with the
concrete sluiceway fully detaching and slipping into the valley. TRCA Engineering Staff met on
site to discuss potential for catastrophic failure and breach of berm, triggering TRCA's Senior
Director of Restoration and Infrastructure to immediately initiate an Emergency Response Plan
due to the 'High to Very High' Hazard Potential Classification (HPC) associated with the dam
and pond. Emergency works commenced the following day in order to establish safe conditions.
By December 2017, dam stabilization and installation of a temporary water control structure
was completed, and the site was deemed safe.
Detailed Design for a final restoration plan and permanent solution was completed in October
2019 and final project approvals were obtained in spring 2020. Construction was completed
between June and September 2020, followed by plantings in fall 2020, and spring of 2021,
mitigating the potential hazard and resulting in no further required maintenance. Restoration of
the Redelmeier Pond area resulted in approximately 900m of stream restoration, 3ha of riparian
restoration, and 0.2ha of wetland restoration.

TAXES AND MAINTENANCE
Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to
receive a property tax exemption under the provincial Conservation Land Tax Incentive
Program, the subject property should be eligible for a tax exemption. While it is expected that
the subject parcel of land will not significantly impact TRCA's maintenance costs at this location,
an assessment of the aggregate acquisitions in the area will be undertaken and the results will
be integrated into TRCA's land management program and associated budgets.

account.

BACKGROUND

TRCA has proposed to undertake remedial slope stabilization works to address upper slope
instability behind four private properties on Peacham Crescent, in the City of Toronto. TRCA is
acquiring a portion of 21 Peacham Crescent to undertake erosion control and slope stabilization
works to address valley slope erosion. These erosion control and slope stabilization works are
currently being prioritized due to the potential risk to human health and safety. TRCA will be
funding the work through the Erosion Risk Management Program. It is a requirement under the
program that there be conveyance of a portion of the valley lands at 21 Peacham Crescent. A
restrictive covenant will also be registered to ensure the retaining wall structure's integrity is
maintained. Remedial work has been tentatively scheduled for October 2021.
Access to the subject lands will be achieved through the adjacent City of Toronto lands.

RATIONALE
The subject property is required for erosion control and slope stabilization works to address
valley slope erosion.

Receipt of a request from the Regional Municipality of York, for a
permanent easement of Toronto and Region Conservation Authority -
owned lands located on the south side of Rutherford Road and west of
Pleasant Ridge Avenue, in the City of Vaughan, Regional Municipality of
York, required for the Rutherford Road Widening within the Don River
watershed (CFN 64501).

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region
Conservation Authority (TRCA) is in receipt of a request from the Regional Municipality
of York for the conveyance of a permanent easement on TRCA-owned lands located on
the south side of Rutherford Road and west of Pleasant Ridge Avenue, in the City of
Vaughan, Regional Municipality of York, required for Rutherford Road Widening, Don
River watershed;
AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in
Section 20 of the Conservation Authorities Act to cooperate with the Regional
Municipality of York in this instance.
THEREFORE, LET IT BE RESOLVED THAT a parcel of TRCA-owned land containing 0.12
hectares (0.29 acres), more or less, of vacant land, required for Rutherford Road
Widening, part of Block 197, plan 65M-4126, designated as Parts 20 and 23 on Registered
Plan 65R-38267, in the City of Vaughan, Regional Municipality of York, be conveyed to
the Regional Municipality of York.
THAT consideration be the nominal sum of $2.00 and all legal, survey and other costs to
be paid by the Regional Municipality of York;
THAT the Regional Municipality of York fully indemnify TRCA from any and all claims
from injuries, damages or costs of any nature resulting in any way, either directly or
indirectly, from this conveyance or the carrying out of construction;
THAT an archaeological investigation be completed, with any mitigation measures being
carried out to the satisfaction of TRCA staff, at the expense of the Regional Municipality
of York;
THAT a landscape plan be prepared for TRCA staff review and approval, in accordance
with existing TRCA landscaping guidelines at the expense of the Regional Municipality of
York;
THAT a permit pursuant to Ontario Regulation 166/06, as amended, be obtained by the
Regional Municipality of York prior to the commencement of construction;
AND FURTHER THAT authorized TRCA officials be directed to take the necessary action
to finalize the transaction, including obtaining any necessary approvals and the signing
and execution of documents.

BACKGROUND
The Regional Municipality of York has requested the conveyance of a permanent easement on
TRCA-owned lands located south side of Rutherford Road and west of Pleasant Ridge Avenue,
in the City of Vaughan, Regional Municipality of York, required for Rutherford Road Widening,
Don River watershed;
The subject TRCA-owned lands were acquired from Rutherford Contwo Investments Ltd. on
September 14, 2020 under the Greenlands Acquisition Project 2006-2010.
All lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA
staff, revegetated with native woody and herbaceous plant material in accordance with existing
TRCA landscaping guidelines. A landscape plan will be prepared as part of the permit
application submission.

RATIONALE
The Regional Municipality of York has conveyed lands to TRCA over the years for nominal
consideration of $2.00 and has requested that TRCA lands required for Rutherford Road
Widening, be conveyed for a nominal consideration of $2.00. TRCA will continue to work with
the Region to determine land requirements related to approved infrastructure projects across
our shared jurisdiction.

RES.#B94/21 - TORONTO ZOO TRIPARTITE AGREEMENT
Update on the execution of the Toronto Zoo Tripartite Agreement and
transfer of lands for the Rouge Gateway and Welcome Centre for the
Rouge National Urban Park in the City of Toronto.

BACKGROUND
At Executive Committee Meeting, held on March 13, 2020, Resolution #137/20 was approved as
follows:
THAT the staff report providing an update on discussion with the Toronto Zoo, City of
Toronto and Parks Canada relating to the Tripartite Agreement and other Zoo related
matters be received,
AND FURTHER THAT the requirement to report back annually on the state of the
Tripartite Agreement be rescinded and that staff be directed to report back once the
Tripartite Agreement has been finalized.
Through extensive work with Toronto Zoo, City of Toronto, Parks Canada, as well as non-
government organizations, all parties executed the updated Tripartite Agreement on May 31,
2021.

RATIONALE
Tripartite Agreement — Update
The City of Toronto, Parks Canada (PC), Toronto and Region Conservation Authority (TRCA)
and Toronto Zoo have worked together this year to form a Rouge National Urban Park (RNUP)
partnership team consisting of a leadership team and various sub -committees which focus on
coordinating and supporting the effective transition from the land acquisition stage to the
successful ongoing operation of the RNUP under Parks Canada Agency. Toronto Zoo, City of
Toronto, PC and TRCA staff have worked to resolve all outstanding matters that had been
preventing the execution of the Tripartite Agreement creating newly formed boundaries of
TRCA-owned lands licensed to the Zoo.
For the agreement, Zoo Road is the only matter that has yet to be resolved. In a letter from the
City of Toronto dated February 24, 2020, the City Manager has requested that TRCA delay
transfer of the portion of lands containing the access road that runs east -west from Meadowvale
road to the CNR tracks to Parks Canada, until such time as all parties have given full
consideration of the interest and shared opportunities for the use of the access road. TRCA staff
feel this request is reasonable and have acceded to the City's request.
TRCA Education and Training staff continue to have ongoing discussions with the Toronto Zoo
to identify opportunities for expanded TRCA programming at the Community Conservation
Campus, including professional training, community learning and school-based education
programs and services. The Community Conservation Campus has the potential to enable
TRCA to reach a new audience of learners while continuing to further strengthen the overall
partnership and strategic alignment with the Toronto Zoo.
Rouge Gateway and Welcome Centre — Update
TRCA staff has worked with PC, City of Toronto and Toronto Zoo staff to define PC's land
requirements for the Rouge Gateway and Welcome Centre. These lands have been transferred
to PC as of May 25, 2021. TRCA is also working closely with PC to inform site planning and to
help strengthen connections from the Rouge Gateway Welcome Centre to The Meadoway, as
part of the TRCA trail strategy.

REGIONAL MUNICIPALITY OF YORK - Humber River Watershed
The purpose is to undertake widening and reconstruction of Teston Road from 2 lanes to a 4
lane urban cross section with turning lanes, roadway storm sewer systems and a multi -use
pathway between Weston Road and Pine Valley Drive, in the City of Vaughan. The proposed
works also include jog elimination at Pine Valley Drive by realigning the east section of Teston
Road. The proposed works involve replacement of four transverse culverts, and an existing 5.9
m x 5 m concrete box culvert at the west tributary of Purpleville Creek (C-2) with a 45.0 m single
span bridge, about 320 m east of Pine Valley Drive. A cured -in-place pipe (CIPP) liner with a
thickness of 15 mm will be applied to an existing 1100 mm diameter corrugated steel pipe
(CSP) culvert at the east tributary of Purpleville Creek (C-6). The proposed works include
realignment of the tributary at Crossings C-2 (west tributary of Purpleville Creek) to
accommodate removal of the existing structure and restoration of the creek corridor, and at C-6
(east tributary of Purpleville Creek) to accommodate the proposed roadway widening and
installation of the retaining wall/bio wall on the south side of Teston Road. A retaining wall in the
vicinity of Crossing C-5 (Purpleville Creek Tributary C-5) is also proposed. All in -water works will
be undertaken in the dry. The Teston Road Class Environmental Assessment (EA) was
completed by York Region in 2017 (CFN 50601). The EA examined improvements to Teston
Road from Pine Valley Drive to Weston Road. The preferred solution from the EA included
widening Teston Road to four lanes and elimination of the jog at Pine Valley Drive.
