Herrdige Seconded by: C.F. Kline RESOLVED THAT: The Minutes of Meeting 13/78, as presented, be adopted. CARRIED 1 PROGRESS REPORT The staff presented a verbal Progress Report: (a) Operation and Development The staff advised that all flood control structures had been inspected fOllowing the spring break-Up; The new workshop located at the Milne Conservation Area is complete 1 An engineering report has been received for proposed repairs to the control building at the Milne Dam 1 The staff advised that eight additional mobile radios were purchased in 1979, completing the three-year programme for the Flood Warning and Forecasting System; C-2 -2- The staff advised that all properties except one have been acquired for the construction of the Stouffville flood control channel and it is anticipated that a contract for the first phase of the work will be awarded by early summer; A draft engineering report has been received for proposed channel improve- ments on the East Branch of the Humber River at Oak Ridges. The report is being reviewed by the staff and officials of the Town of Richmond Hill; Slides were shown of the restoration works which have been carried out on the Highland Creek. The programme will be completed in 1979 at a total estimated cost of $775,000.00; Erosion Control Programme: The staff advised that Project W.C.-60 -A Project for Erosion Control and Bank Stabilization in Metropolitan Tor~nto: 10-Year Programme and 5-Year Project" was completed in 1978, and that all the works are now being carried out under the Interim Water and Related Land Management Project: 1979-1981. Additional monies have been made available in The Municipality of Metropolitan Toronto, and erosion control projects are also to be carried out in the Regions of Peel, York and Durham. The staff showed slides of completed erosion control sites: .Don valley Drive on the main Don River .Sulkara Court on the East Branch of the Don River .Stanwood Crescent on the Main Humber River Slides were shown of sites where works are to be undertaken in 1979: .35 Canyon Avenue on the West Branch of the Don River .Codeco Court on the Main Don River .Enfield/Jellicoe/Sunset Avenues on the Etobicoke Creek .Riverview Heights on the Main Humber River The following sites ~re scheduled for 1980: .Wynford Heights on the Main Don River .Fernwood Gardens on the Main Don River .Bruce Farm Drive on the East Branch of the Don River .Presley Avenue on the Massey Creek .Alamosa Drive on the East Branch of the Don River .Weir Crescent on the Highland Creek Sites located in The Regional Municipalities of Peel, York and Durham: .Sherway Drive on the Etobicoke Creek (Peel) .Rainbow Creek, a tributary of the Humber River (York) .Elizabeth Street, Pickering, on the Duffin Creek (Durham) The staff advised that on March 3 and 4, 1979, both the Claireville Dam and Reservoir and the G. Ross Lord Dam and Reservoir were operated to reduce flood peaks during the spring runoff. (b) Hydrology Study Mr. Ron Wigle of the firm James F. MacLaren Limited, outlined for the Board the present status of the hydrology study. It is anticipated that the final draft of the report will be completed in the near future, and following review by the staff and the Ministry of Natural Resources, it is expected that the final report will be available during the month of May. The Authority has been able to make available to the municipalities calculated flood flows on the various streams under the Authority's juris- diction. Flood flows have been calculated for present land use and future land uses, and the models have been calibrated to check accuracy. The staff advised that the Hydrology Study is an excellent report and will form the basis of all future flood control and water management programmes of {he Authority. -3- C-3 (c) Flood Line Mapping The mapping programme was started in 1976 'and will be completed in 1979. The staff reviewed samples of the small and large format sheets; maps were also available showing cross sections of various flood stages on sample rivers under the jurisdiction of the Authority. All mapping is complete and received except for the Humber River. The mapping will also form the basis for the development of the flood control and water management programme of the Authority. (d) Plan Development It is anticipated that the staff will be in a position to prepare draft policies and programmes for flood control and water management for consid- eration of the Board by the end of 1979. CARRIED 1 REPORT ON THE 1978 WATERSHED ENVIRONMENTAL MONITORING PROGRM1ME A staff communication was presented advising that 1978 marked the third year of the Watershed Environmental Monitoring Programme, which included regular water monitoring and sediment and macro-invertebrate surveys at 8 sites. Special studies were also continued or initiated. Res. #3 Moved by: Wm. R. Herridge Seconded by: C.F. Kline RESOLVED THAT: The staff communication, together with the report entitled, "Watershed Environmental Monitoring Programme, 1978" be received for information. CARRIED; 1979 WATERSHED ENVIRONMENTAL MONITORING PROGRAMME A staff communication was presented advising that the 1979 Programme is designed to extend the data collected in 1977 and 1978. The data collected in 1979 will be analyzed with 1977 and 1978 data in order that conclusive state- ments may be made regarding the effects of Authority works on the aquatic environment. Res. #4 Moved by: C.F. Kline Seconded by: WID. R. Herridge RESOLVED THAT: The staff communication having regard to the 1979 Watershed Environmental Monitoring Programme be received; and THE BOARD RECOMMENDS THAT the 1979 Watershed Environmental Monitoring Programme, involving an estimated expenditure of $80,924.40, be approved; and THAT the firm of Environmental Applications Group be retained as the programme consultant. CARRIED; AUTHORITY LIABILITY REGARDING EROSION A staff communication was presented having regard to Res. #20 of Meeting #3/78 of the Board, as follows: "Res. #20: RESOLVED THAT: The staff be requested to obtain a legal opinion on the Authority's responsibility with respect to the erosion on the property of Mr. C. Dudley Reburn, 91 Forest Grove Drive, Borough of North York. " The Authority solicitor was contacted for an opinion on this matter. The solicitor's response was divided into two parts: (a) Authority liability regarding river erosion on private or Authority-owned property as a result of natural processes. The solicitor's opinion in this regard is that the Authority cannot be held liable in these instances; (b) Authority liability should it be determined that erosion occurred due to works carried out by the Authority or failure of the Authority to maintain its erosion control devices. : : . Swann RESOLVED THAT: The staff report, together with the report of Gardiner, Roberts, Barristers & Solicitors, with regard to the Authority's liability respecting erosion, be received for the information of the Board. CARRIED; OTHER BUSINESS INTERIM WATER & RELATED LAND MANAGEMENT PROJECT 1979-1981 -35 Canyon Avenue (Don River - West Branch) Res. #6 Moved by: Wm. R. Herridge Seconded by: G. Fisher THE BOP~D RECOMMENDS THAT: The Executive Co~~ittee be requested to take what- ever steps are necessary to expedite the undertaking of erosion control works at 35 Canyon Avenue on the West Branch of the Don River; AND FURTHER THAT the opinion of the Authority solicitor be obtained regarding action which may be taken by the Authority, under The Expropriations Act, to expedite expropriation of the lands required for the works. CARRIED; TWENTY-FIFTH ANNIVERSARY OF HURRICANE HAZEL The staff advised the Board that the Information and Education Advisory Board had recommended that the Authority organize a Flood Control and Water Manage- ment Seminar on a suitable date close to October 14-15, 1979 in recognition of the Twenty-Fifth Anniversary of Hurricane Hazel. Fisher RESOLVED THAT: The Flood Control and Water Conservation Advisory Board support the proposal of the Information and Education Advisory Board to organize a Flood Control and Water Management Seminar on a suitable date close to October 14-15, 1979 in recognition of the Twenty-Fifth Anniversary of Hu=icane Hazel; and THAT the Chairman of the Flood Control and Water Conservation Advisory Board be appointed to a committee to organize the seminar. CARRIED; The Chairman, Mr. Garrett and Mr. Higgs were requested to consider the arrange- ment of an informal meeting of the Board some time during the fall when the staff has completed draft policies and plans for flood control and water managemen t. CARRIED; PROGRJ:SS REPORT The staff presented a verbal Progress Report, indicating that the work of the Water Resource Division is proceeding on schedule: Under the category of Major Maintenance, the security fencing of the Brampton Channel is complete, as is the study of the Lower Humber weirs; Purchase of radios for the Flood Warning and Forecasting System is complete; Hydrology studies of watersheds is complete and the final report is pending; The consultant's study of Damage Centres is in progress; Environmental monitoring work has proceeded as planned; Improvements to the Milne Workshop have been carried out: The contract for the channel work in the Town of Stouffville has been awarded and work has started: Work has been completed or is in progress on a number of sites under this year's Erosion Control Programme. Grant Henderson RESOLVED THAT: The 1980 Budget Estimates for the Water Resource Division, Flood Control Section, dated 1979.08.10, be approved in principle; and THE BOARD RECOMMENDS THAT: The 1980 Budget Estimates for the Flood Control Section, Water Resource Division, as appended as Schedule "A" of these Minutes, be included in the 1980 Preliminary Budget Estimates of the Authority. CARRIED i HUMBER RIVER AT OAK RIDGES A staff communication was presented advising that the Oak Ridges area, located on the East Branch of the Humber River, and particularly the area between Parker Avenue and Schomberg Road, is poorly drained and has resulted in a repeated flood- ing problem for the surrounding residential area. In 1969, the Authority undertook a preliminary engineering study to investigate the problems and recommend solutions. The report recommended a major flood control channel but, due to budget limitations, the channel was not constructed. Due to the lapse of time since the above study, the firm of M.M. Dillon Limited was retained to review and re-evaluate the flooding problems in Oak Ridges and to investigate alternative solutions. Their final report has now been received. Res. #11 Moved by: C.F. Ge11 RESOLVED THAT: The staff communication on Channel Improvements on the East Branch of the Humber River in Oak Ridges, be received; and THE BOARD RECOMMENDS THAT: The staff be directed to prepare a brief outlining the construction details'and cost breakdown for Channel Improvements on the East Branch of the Humber River in the community of Oak Ridges, Town of Richmond Hill, for the approval of The Metropolitan Toronto and Region Conservation Authority, The Regional Municipality of York and the Ministry of Natural Resources. EROSION AND SEDIMENT CONTROL PROGRAMME The members remaining discussed the Erosion and Sediment Control Programme as presented by staff, and a number of comments were made. WATER AND RELATED LAND ACQUISITION PROGRAMME It was agreed that an additional meeting would be required to consider the Water and Related Land Acquisition Programme. J.S. Scott W.A. Mtg. #2/79 FROM: Mr. M. R. Garrett, Administrator, Water Resource Division. RE: 1980 BUDGET ESTIMATES Attached are the Budget Estimates for 1980. They reflect the breakdown approved as part of the Interim Water and Related Land Management Project 1979-1981. There are three categories: (1) Interim Project (2 ) Operations and Maintenance ( 3) Supplementary Project - Keating Channel The Interim Project totals $3,S90,000 which is a reduction from the 3.8 million proposed in the Interim Project due to a reduced level of funding required in the Region of York in the Benefiting Municipality Projects. The Operations and Maintenance Program totals $203,000 for 1980. The Supplementary Project Dredging of the Keating Channel is estimated to be $100,000 in 1980 which is a change from the original estimate due to the delay in the dredging for 1979. Each of the budgets has been broken down into 'All Municipalities Benefiting" and "One Municipality Benefiting". The attached sheets explain the expenditures proposed. The Budget reflects 1979 salary levels and will require adjustment at a later date. RECOMMENDATION: THE BOARD RECOMMENDS THAT: The 1980 Budget Estimates for the Interim Water and Related Land Management Project and for the Flood Control Operations and Maintenance of the Flood Control Section of the Water Resource Division be approved. Funding: This is shared program, SS% of the funds being available from the Province of Ontario and the balance being funded from the participating municipalities. The Interim ProJect as indicated encompasses both generally benefiting and specifically benefiting municipality projects. The projects are listed under the appropriate heading. The municipal share in both cases is 45% of the costs. CARRIED 1 NEW BUSINESS KEATING CHANNEL DREDGING The Board reviewed the status of the Keating Channel Dredging project, and expressed concern at the likelihood that the dredging would not begin during 1979. The Board was aware that, among other environmental concerns in the Keating Channel problem, there is the increased threat of flooding in the Lower Don area resulting from the deposition of silt in the Keating Channel. The Board was informed that the delay in the dredging project results from the slower than anticipated rate at which the containment for the dredge spoil is being constructed on the south shore of the Outer Harbour Headland. RESOLVED THAT: The Metropolitan Toronto and Region Conservation Authority express concern to the agencies participating in the Keating Channel Dredging Project about the delay in the project and recommends that, should it not be possible to commence dredging in 1980, the decision not to dispose of the dredgeate in the open water of Lake Ontario be reconsidered. The original priority ratings listed in the James F. MacLaren report of ~larch, 1970, are used as a starting po~nt in assessing the rate of progress and deterioration during the nine years that have ela~sed. Based on year-round monitoring, the severity of the ploblem in ~ts present st.a te and a fair idea of its relative potential to deteriorate, the staff has determined a pool of sites bearing high priority ratings. Because erosion ~s a dynamic problem, the priorities within this pool change cont~nually as we strive to ameliorate the list with the steady influx of technlcal data on site conditlons. Therefore, the following list of "current pr~orities" will be reviewed regularly during 1980 in order to accommodate any significant changes and the possible inclusion of new sites. Since site conditions change continually, the priorities have to be reviewed on a regular basis. The current top priorities are reflected in the work programme for 1980 and the "Pool of Erosion Priority Sites" for 1981, which are found in the respective sections of this report. It should be noted that for the Regions of York and Durham, the technical priorities identified in the appropriate column of the attached charts follow from the annual erosion priority review. In Peel, however, this was not totally possible because of the requirement for "equalized assessment" based on cash flow from the constituent municipalities within the Region. In the lattercase, it was therefore necessary to establish priorities within each municipality and then schedule the sites in descending order. Consequently, it was not possible to adhere to relative priorities established on a regional basi.s. The table below shows the budget allocation by Region for the years 1979-1981, inclus~ve. The first year of this project has now been completed under the Interim Water and Related Land Management Plan. The original priority ratings listed in the three separate Erosion Inventory and Priorities Studies of 1977, are used as a starting point in assessing the rate of progress and deterioration of erosion sites during the years that have elapsed. Based on year-round monitoring, the severity of the problem in its present state and a fair idea of its relative potential to deteriorate, the staff has determined a pool of sites bearing high priority ratings. Because erosion is a dynamic problem, the priorities within this pool change continually as we strive to ameliorate the list with the steady influx of technical data on site conditions. Therefore, the following list of "current priorities" will be reviewed regularly during 1980 in order to accommodate any significant changes and the possible inclusion of new sites. Kline THE BOARD RECOMMENDS THAT: In view of the limited flood control and conservation benefit of the proposed new dam for the Toogood Pond in Unionvillc, the Town of Markham be advised that The Metropolitan Toronto and Region Conservation Authority is not prepared to assume the responsibility for the design, construction, operation and maintenance of said dam; and THAT appropriate Authority staff and representatives of the Ministry of Natural Resources meet with officials of the Town of Markham to provide them with technical advice regarding the proposed project. These policies are to be used as the basis for implementing flood plain management in Ontario. The Ministries of Natural ReSOtll ces and Ilousing conducted a comprehensive reyiew of the flood plain criteria and in 1977 released a Discussion Paper on flood Plain ~~nagement Alternatives in Ontario. The revie~ process and the corrnncnts receiyed from mlU1icipalities, Conservation Aut.horities, individuals and groups interested in flood plain management have led to the development of the Provincial Flooq Plain Criteria, which are nO\'; be ing re leased as a statement of 'Government Policy. They are designed to provide the necessary framework \oJi thin which the implementation procedures are to be developed and co-ordinated.
