CARRIED UNANIMOUSLY; A Staff communication was presented regarding the Extension to the Plan for Flood Control and Water Conservation, and this presentation was discussed in considerable detail. Lawrie C -2 -2- RESOLVED THAT: The Staff communication pertaining to Project W.C. 63 - "Extension to the Plan for Flood Control and Water Conservation" be received and appended as Schedule "A" of these Minutes; and further THE BOARD RECOMMENDS THAT: Project W.C. 63 - "A Project for the Extension of the Plan for Flood Control and Water Conser- vation" be amended; and further in this connection THAT the following action be taken: (i) All municipalities be designated as benefiting on the basis as set forth in the Project; (ii) The Project be submitted to the Minister of Energy & Resources Management for his approval and for grants on the basis as set forth in the Project; (iii) The Project be submitted to the Ontario Municipal Board for approval and necessary action; When the necessary approvals have been obtained, the appropriate Authority officials be authorized to take whatever action is required in connection with the Project, including the execution of any necessary documents. (iv) CARRIED UNANIMOUSLY; PROCESSING OF PLANS OF SUBDIVISION, OFFICIAL PLANS, ZONING BY -LAWS, ETC. A Staff communication was presented outlining the procedures followed within the Authority in connection with the processing of various planning matters. This Staff Report was considered in considerable detail. Res. #4 Moved by: Seconded by: V. Yerex P.V. Godfrey RESOLVED THAT: The Staff communication re processing of appli- cations for subdivision plans, zoning amendments, official plan amendments, etc. be received and appended as Schedule "B" of these Minutes; and further THE BOARD RECOMMENDS THAT: The following action be taken with regard to the processing of applications for subdivision plans, zoning amendments, official plan amendments, etc.: (i) The Staff continue to increase its efforts in the matter of co- operation and co- ordination with municipalities and other government agencies, and that to achieve this end, the Staff be authorized to fill the vacant position "Planning Technician" at the earliest possible date; (ii) The Authority continue its present efforts to co- operate with the municipalities in the acquisition of lands necessary to achieving its programmes and objectives; (iii) Every effort be made to obtain additional funds from senior levels of government to enable this Authority to more actively pursue its programme of Flood Plain and Conservation Land Acquisition. CARRIED UNANIMOUSLY; PROJECT W.C. 59 - "EROSION CONTROL AND CHANNEL IMPROVEMENTS ON THE HIGHLAND CREEK FROM HIGHWAY #401 TO SHEPPARD AVENUE" Project W.C.59 - "A Project for Erosion Control and Channel Improvements on the Highland Creek from Highway #401 to Sheppard Avenue" was presented and considered in detail. Res. #6 Moved by: Mrs. N. Horwood Seconded by: R.G. Henderson RESOLVED THAT: The Brief of Project W.C. 59 - "A Project for Erosion Control and Channel Improvements on the Highland Creek from Highway #401 to Sheppard Avenue" be received and appended as Schedule "C" of these Minutes; and further THE BOARD RECOMMENDS THAT: Project W.C. 59 - "A Project for Erosion Control and Channel Improvements on the Highland Creek from Highway #401 to Sheppard Avenue" be adopted; and further in this connection THAT the following action be taken: (i) The Municipality of Metropolitan Toronto be designated as benefiting municipality; (ii) The Minister of Energy and Resources Management be requested to approve of the Project and of a grant of 50% of the cost thereof; (iii) When approved, the appropriate Authority officials be authorized to take whatever action is required in connection with the Project, including the execution of any necessary documents. CARRIED UNANIMOUSLY; C -6 -6- CHANNEL IMPROVEMENTS - EMERY CREEK, BOROUGH OF NORTH YORK The Staff presented a verbal report concerning a request of The Municipality of Metropolitan Toronto that the Authority adopt a Project for the undertaking of certain erosion control and channel improvement measures on the Emery Creek from Lanyard Road to the Humber River, at a total estimated cost of $600,000.00. Res. #7 Moved by: J.G. Mottershead Seconded by: D. Walden RESOLVED THAT: The verbal report concerning a request of The Municipality of Metropolitan Toronto that the Authority adopt a Project for the undertaking of certain erosion control and channel improvement measures on the Emery Creek from Lanyard Road to the Humber River, be received! and further THE BOARD RECOMMENDS THAT: Project W.C. 6$ - "A Project for Erosion Control and Channel Improvements on the Emery Creek from Lanyard Road to the Humber River" at an estimated cost of $600,000.00, be adopted; and further in this connection THAT the following action be taken: (i) The Municipality of Metropolitan Toronto be designated as benefiting municipality, as agreed by the said municipality; (ii) The Minister of Energy and Resources Management be requested to approve of this Project and of a grant of 50% of the cost thereof; (iii) When approved, the appropriate Authority officials be authorized to take whatever action is required in connection with the Project, including the execution of any necessary documents; and further THAT the Staff be authorized to obtain a proposal for the provision of necessary engineering services in connection with this Project from the firm of Totten, Sims, Hubicki (Canada) Limited,Consulting Engineers. CARRIED UNANIMOUSLY; REHABILITATION OF MILL POND, RICHMOND HILL The Staff presented a verbal report concerning a request by the Town of Richmond Hill that the Authority undertake the rehabil- itation of the Mill Pond. The Staff further reported that this matter has been discussed with officials of the Conservation Authorities Branch on a preliminary basis and were advised that this Project would not appear to qualify for 75% grants under the Assistance - Small Dams programme; however, there was some possibility of obtaining a 50% grant, subject to certain provisos and conditions. Yerex RESOLVED THAT: The verbal report concerning a request by the Town of Richmond Hill that the Authority undertake the rehab- ilitation of the Mill Pond, be received; and further -7- C -7 THE BOARD RECOMMENDS THAT: The Staff be directed to negotiate further with officials of the Conservation Authorities Branch, Ontario Department of Energy & Resources Management, concerning the request for assistance with the rehabilitation of the Mill Pond in Richmond Hill, and further THAT the Staff report directly to the Executive Committee. CARRIED UNANIMOUSLY; PROJECT W.C. 61 - "CHANNEL IMPROVEMENTS ON THE DUFFIN CREEK IN THE VILLAGE OF STOUFFVILLE" A Staff communication was presented concerning proposed channel improvements on the Duffin Creek in the Village of Stouffville. This communication was discussed in some detail. Res. #9 Moved by: F.J. McKechnie Seconded by: H.C. Lawrie RESOLVED THAT: The Staff communication in connection with Project W.C. 61 - "A Project for Channel Improvement on the Duffin Creek in the Village of Stouffville" be received; and further THE BOARD RECOMMENDS THAT: Project W.C. 61 - "A Project for Channel Improvements on the Duffin Creek in the Village of Stouffville" at an estimated cost of $600,000.00, be adopted; and further in this connection THAT the following action be taken: (i) The Regional Municipality of York be designated as benefiting municipality; (ii) The Minister of Energy & Resources Management be requested to approve of this Project and of a grant of 50% of the cost thereof; (iii) When approved, the appropriate Authority officials be authorized to take whatever action is required in connection with the Project, including the execution of any necessary documents: (iv) The approval of the Ontario Municipal Board be requested for the financing of this Project, if required. CARRIED UNANIMOUSLY; FLOOD CONTROL MEASURES - VILLAGE OF CALEDON EAST Discussion took place concerning the report prepared some time ago for the Village of Caledon East recommending certain remedial measures for flood control purposes on the Centreville Creek - a major tributary of the Humber River. Res. 40 Moved by: Seconded by: D. Walden C.F. Kline RESOLVED THAT: The Staff, in consultation with appropriate officials of the Village of G'Aledon East, make a review of flood control measures necessary for the Village, with a view to providing some interim relief to the local flooding problem; and further THAT the Staff report directly to the Executive Committee. CARRIED UNANIMOUSLY; OTHER BUSINESS A number of items of general interest to the Board were discussed under the heading "Other Business ". Arising from this discussion, the following specific recommendations were noted for future consideration: (a) THAT a slide presentation similar to that accompanying the presentation of Project WC 63 to the various municipalities be made for the information and assist- ance of the Board at one of its future meetings; (b) THAT one of the future meetings of the Board at an early date take the form of a tour of various Flood Control and Water Conservation Projects of the Authority. I N T R O D U C T I O N ADOPTION OF THE PLAN: On September 2, 1959, the Authority adopted the following resolution: WHEREAS the Metropolitan Toronto and Region Conservation Authority authorized the preparation of a Brief on Flood Control and Water Conservation and a committee consisting of Dr. G. Ross Lord, Mr. Frederick G. Gardiner, Mr.. A.H. Richardson and Mr. R.G. Henderson was duly appointed; AND WHEREAS the said committee presented a Brief on Flood Control and Water Conservation to a joint meeting of the Flood and Pollution Control Advisory Board and the Executive Committee on December 10, 1958, and the recommendations of the Flood and Pollution Control Advisory Board as set forth herewith were adopted by the Executive Committee at this meeting: 1. that the Brief on Flood Control and Water Conservation, 1958, as prepared under the direction of the Brief Sub- committee, be adopted by the Authority; 2. that when the said Brief is adopted by the Authority, it be submitted as expedient to the Council of Metro- politan Toronto, the Councils of all other benefiting municipalities, the Government of the Province of Ontario and the Government of Canada, requesting their approval and financial support on the basis outlined in the said Brief; AND WHEREAS the recommendations of the Flood and Pollution Control Advisory Board and the Executive Committee were presented to a full meeting of the Authority held on December 12, 1958, and the following resolution was passed: "That the Brief on Flood Control and Water Conservation, 1958, be adopted in principle by the Authority, as recommended by the Flood and Pollution Control Advisory Board and the Executive Committee; and further that the said Brief be submitted as expedient to the Council of Metropolitan Toronto, the Councils of all other benefiting municipalities, the Government of the Province of Ontario and the Government of Canada, requesting their approval and financial assistance on the basis outlined in the "Brief ", AND WHEREAS the Executive Committee appointed a committee consisting of Dr. G. Ross Lord, R.G. Henderson and K.G. Higgs for the purpose of presenting the Brief on Flood Control and Water Conservation to all member municipalities of the Authority; AND WHEREAS the said committee appeared before the Councils of twenty-three member municipalities of the Authority and presented a detailed outline of the Brief on Flood Control and Water Conservation, together with a summary of the effects of the works proposed in the Brief on that particular municipality and the cost to the municipality; AND WHEREAS the Authority has received copies of resolutions from the Councils of the following municipalities endorsing the Authority's Brief on Flood Control and Water Conservation: C -13 2. 1. Pickering Township THEREFORE BE IT RESOLVED that the Metropolitan Toronto and Region Conservation Authority adopt the Brief on Flood Control and Water Conservation; a proof copy of which is attached to this resolution; and further that the said Brief be submitted to the Government of Canada and the Province of Ontario, requesting their approval and financial assistance on the basis outlined in the Brief; AND BE IT FURTHER RESOLVED that the Executive Committee be authorized to appoint a committee for the presentation of the Brief on Flood Control and Water Conservation to the respective Governments. At Authority Meeting "4 held June resolutions were adopted: ADOPTION OF FLOOD CONTROL & WATER SCHEME OF THE ',UTHORITY: 14, 1961, the following CONSERVATION PLAN AS :. Resolved that: Whereas the Agreement between the Government of the Province of Ontario and the Metro- politan Toronto and Region Conservation Authority has been received; Therefore, Be It Resolved That: The Plan for Flood Control and Water Conservation as submitted to the Member Municipalities, the Government of the Province of Ontario, and the Government of Canada, be adopted as a Scheme of the Metropolitan Toronto and Region Conservation Authority and carried out as provided in the .'agreement appended as Schedule "A" of the Authority Minutes. UTHORIZATION OF THE SIGNING OF THE AGREEMENT: Resolved That: Whereas the Plan for Flood Control and Water Conservation has this day been adopted as a Scheme of the Metropolitan Toronto and Region Conservation Authority, and the Agreement between the Government of the Province of Ontario and the Metropolitan Toronto and Region Conservation Authority has been received; Therefore, Be It Resolved That: the Chairman and the Secretary -Treasurer be, and hereby are, :authorized and directed on behalf of the Metropolitan Toronto and Region Conservation Authority to execute the said Agreement with the Government of the Province of Ontario providing for carrying out of the Plan for Flood Control and Water Conservation of the Authority on the basis outlined therein. C -1!+ 3. Policy with respect to Flood Control Measures: The policy of the Metropolitan Toronto and Region Conservation Authority with respect to flood control measures is based on the following premises: (1) While a complete programme of protective works based on full development of potential reservoir sites would be desirable, it is not economically feasible to protect every vulnerable area in such a manner. (2) A programme of protective works without a companion programme of flood land acquisition is undesirable because it could not afford the necessary protection to all areas; and because a disproportionately large share of benefits would accrue not to the public but to a small number of private owners. (3) A programme of flood plain acquisition without a companion programme of protective works is undesirable because it is not feasible to condemn certain public properties and certain densely developed vulnerable areas. Also, protective works are necessary to permit the full development of any acquired lands as conservation areas and parks. (4) Although it is an effective measure, municipal action involving zoning and land use restriction is limited in its scope of application because (a) it cannot be readily applied to all existing developments, and (b) it would be inequitable to apply it without compensation in those cases where both long -term and speculative short -term investments have been made in good faith by land developers. Where land is currently being used for purposes other than commercial and housing development, and where the land is eminently suitable for those purposes (e.g. farming), zoning and land use restrictions are reasonable measures. (5) Social and economic considerations demand that any reservoir developments should serve multiple purposes with recreation and summer flow regulation second only to flood control as deciding factors. (6) Since the streams are vital to the health and social welfare of the people, and since they constitute one of the few remaining potential conservation areas in :s growing urban centre, they should be utilized to provide the maximum benefit for the maximum number of people. Based on the foregoing premises, it is the flood control policy of the Metropolitan Toronto and Region Conservation Authority to pursue a comprehensive programme of flood control measures consisting of a combination of (1) the construction of protective multi -purpose dams and reservoirs and protective channel improvements; and (2) the C -15 4. acquisition of flood plain land at equitable prices wherever feasible, and the zoning and regulation of flood pl nin lands where acquisition is not feasible or desirable. Further, it is the policy of the Authority to pursue n comprehensive programme of ancillary conservation measures rnd , programme of development of recreation and park lands in such a way as to maximize and perpetuate the benefits bestowed by nature. With respect to the design of d-'.m spillways, the Authority's policy is as follows: (1) To safeguard downstream communicities and human life, all dam spillways must be designed to prevent over-topping and destruction of the dams. All spillways will be designed to carry the maximum possible flow produced by the maximum possible rainfall. (2) By the same token, all downstream spillways will be designed to carry the maximum possible flow that could result if upstream dams were rendered inoperative by virtue of overfull reservoirs or structural failure, thus making c'ch dam independent of others for safety. The above policy, which was adopted in 1959, has guided the :authority in its programme for the past 11 years, and is deemed to be as valid today as it was at the time of its adoption. C -16 5. Ancillary Measures Programme: In compliance with the conditions of the .Agreement between the Authority and the Province of Ontario, and to enable the Authority to realize the optimum benefit from the potential of the Plan for Flood Control, a Plan of Ancillary Conservation Measures was adopted. The Plan, covering the period 1962 - 1978, envisaged a programme of resource management upstream of proposed reservoirs and in headwater areas involving reforestation, fish and wildlife management, streambank erosion control and the provision of outdoor recreation opportunities. In progressing with the programme, the .'Authority has completed the following work: REFORESTATION 1962 - 1970 TREES PLANTED Authority Land 1,684,309 (approx. 1,600 acres) Private Land 2,228,817 (approx. 2,200 acres) WILDLIFE SHRUB PLANTING 1962 - 1970 Authority Land 171,730 Private Land 17,365 STRE",MB:NK EROSION CONTROL 1964 - 1970 FEET REPAIRED Authority Land 2,500' Private Land 14,950' DEVELOPMENT OF RECREATIONAL LANDS 1962 - 1970 In addition to the progressive development of Conservation Areas during the period of the Plan, the following lands, .Acquired as a part of the Flood Control Plan, have been developed for recreation purposes: Lower Rouge River Flood Plain Clnireville Reservoir (Humber) Master plans of development have been prepared for: Clairevillc Reservoir (Humber) Milne Reservoir (Rouge) Boyd Reservoir (Humber) Flood Plain and Conservation Lands acquired under the Plan within Metropolitan Toronto have been placed under a development and management agreement with the Municipality. Recreation facilities have been developed at the following locations: Humber Rowntree Mills Park Scarlett Mills Park Etienne Brule Park C -17 6. Black Creek Downsview Dells Don Central Don Pnrk ('Wilket Creek) (Ernest Thompson Seton) (Taylor Creek) Ontario Science Centre (agreement with Province) Highland Creek Highland Creek Park Rouge Metropolitan Zoo (Master Development Plan) The :authority proposes to continue the ancillary Measures Programme as set out under the Plan adopted in February, 1962. C -1$ 7. Progress to Date: The accompanying table outlines the works included in the Plan and indicates the progress made to December 31, 1970. Property Acquisition Property acquisition has been proceeding as far as possible as lands become available, regardless of the specific project. Exceptions to this practice have been made for specific Projects, such as the Claireville Darn and Reservoir, the Milne Dam and Reservoir, the Woodbridge Flood Control Channel and sections of the Black Creek Channel. It should be noted that figures showing acquisition of Flood Plain and Conservation Lands include some lands purchased under individual Projects (Schemes) initiated prior to 1961. Engineering Studies Before proceeding with any of the works proposed in the Flood Control Plan, it has been necessary to secure a series of preliminary engineering studies to: (i) Confirm the feasibility of the structures; (ii) Confirm its adequacy to achieve the objectives set out in the Plan; In addition to the preliminary studies indicated in the Table, the Authority has, from time to time, undertaken other Flood Control Studies in the region under its jurisdiction. Many of these Studies have been undertaken at the request, and with the assistance of, the municipalities involved. These Studies include: Flood Protection - Village of Stouffville Etobicoke Creek at Brampton Mimico Creek Watershed Etobieoke Creek Watershed In accordance with the provisions of the :Agreement between the :authority and the Province of Ontario, the Authority has submitted a programme for the control and operation of the dams and reservoirs under routine and emergency conditions, and a programme for the Establishment and Maintenance of Hydrometric and Recording Rain Gauges in the region. The Authority has developed a system of flood warning and fore- casting involving a network of recording stream gauges, recording rain gauges, and small plastic rain gauges read by volunteer readers for the purpose of collecting data, and has established a system for the co- ordination of supplying this data to the Conservation Authorities Branch and responding to operational directions issued by the Branch. A preliminary engineering study has been completed for a system of Telemetering, Supervisory Control and Communications C -19 8. for Flood Control Purposes. ;rising from this report, the Authority has established a Pilot System of Telemetering and Communications to test the relative efficiency of land lines and radio equipment. In order to call tonaurs for the construction of individual structures, additional engineering studies are required to enable the preparation of final drawings Ind tender specifications. Final design has been undert kon at ns short a time ns possible before the structure is to be built to ensure thz.t any local changes relative to services, roads, physical landscape, etc., are taken into account. In addition to the construction of works completed under the Plan, certain other remedial measures have been undertaken, including the Black Creek Retardation Dam, Stouffville Dam and Reservoir, Flood Control Works in the Town of Brampton, and various Channel Improvement Works undertaken with the use of authority forces, principally on the Highland, Mnsscy and Mimico Creeks and the Humber River. C -21 9. I. DETAILS OF'PROJECT (a) Location and Description: Works Currently, Proposed - Just as total completion has not been possible under the original period of the Plan, it would be misleading to suggest that all of the objectives can be attained »nder the current Extension. Major progress toward this end can be anticipated however, with the following specific works proposed: Pinch Dam and and Reservoir_ While the Plan for Flood Control recommended three dams and reservoirs on the West Don River, a subsequent engineering study indicates that the same total storage capacity can be provided more economically by increasing the size of the Finch Dam and eliminating the Haviland and Westminster structures. Direct savings result from a reduced acreage of land to be acquired and from the construction of only one instead of three spillway structures, each of which would have required nearly the same capacity. The proposed damsite is on the West Don River approximately 1,000 feet north of Finch Avenue. The dam will be an earthfill structure, 65 feet in height, with spillway works including a gated concrete chute for flood flows and a low -level discharge tube for regular flows. Among the sections of the drainage area to receive direct flood protection are the York Mills Valley and the Ontario Science Centre. A permanent pool of nearly fifty acres will provide some potential for public recreation. Bolton Dam and Reservoir The proposed Boltom Dam on the Main Humber River will occupy Parts of Lots 10 and 11, Concession 6, Albion Township, about half - a -mile• northwest of the Village of Bolton. The dam is to be a rolled earth structure, with a concrete spillway section. The dam will be 95 feet high, with a maximum reservoir depth of 90 feet at the dam. This dam will produce a reservoir with a maximum surface area of 700 acres and a maximum storage capacity of 24,400 acre feet. This storage will afford direct flood protection for the Village of Bolton and the Village of Woodbridge, and will further augment control of flood flows downstream of Thistletown through Metropolitan Toronto. This reservoir will also afford some potential for recreation on a passive basis as outlined in the Plan for Ancillary Measures. Arthur Percy Dam and Reservoir The proposed Arthur Percy Dam is to be constructed on the East Branch of the Duffin Creek near the southerly limit of the Greenwood Conservation Area. The dam is to be an earth-fill structure with a low-level service spillway constructed in the earth embankment near the Creek bed; and a high -level auxiliary spillway on the high ground at the abutments. The dam will be 65 feet high. The resultant reservoir will have a storage capacity of C -22 I. DETAILS OF PROJECT • (a) Location and Description (Contd.) 5,500 acre feet, a maximum reservoir area of 210 acres, and a permanent recreation pool of about 100 acres. Construction of the Arthur Percy Dam will afford a measure of protection for the Village of Pickering and adjacent Pickering Township lands by controlling the flood flows from the East Branch of the Duffin Creek. The permanent lake will provide the basis for a major recreational facility in the eastern portion of the region under the jurisdiction of the Authority. Snelgrove Dam and Reservoir The Snelgrove Dam and Reservoir is proposed for the Etobicoke Creek, some 4 miles north of Brampton on the east side of Highway No. 10 near Snelgrove. The potential storage capacity of 4,500 acre feet will provide some measure of downstream flood protection, will be of considerable value .in the augmentation of summer flow, and be available for limited recreational use. The dam will be 44 feet high and will be a rolled earth Structure with concrete spillway section for regulation of reservoir level. Reservoir Lands Reservoir land acquisition is to proceed with priority being given to finalizing the purchase of those lands currently under expropriation. The next priority will be given to the acquisition of those lands necessary to complete the construction of the Finch, Bolton, Arthur Percy and Snelgrove Reservoirs. Other reservoir lands may be acquired within the framework of funds remaining in any given year, with emphasis being placed on the Ebenezer site. 10. C -23 11. Flood Plain and Conservation Lands On February 9, 1962, the Authority adopted a Master Plan for Flood Plain and Conservation Lands, which Master Plan was approved by the Province of Ontario on August 20, 1962. This Master Plan was an elaboration of a Policy Statement pertaining to Flood Plain and Conservation Lands as adopted by the Authority on May 12, 1961. In this policy statement, flood plain lands were defined as including the area adjoining the river or stream which has been or may hereafter be covered by flood water. Conservation lands as applied to the lower sections of the main valley systems means all lands included in the main valley systems from one crest of the valley to the opposite crest and which contain within them steep valley slopes, low -lying marshy areas, flood plain lands, floodways and river beds. It is further the policy of The Metropolitan Toronto and Region Conservation Authority to acquire flood plain and conservation lands in the downstream sections of the main valley systems under the jurisdiction of the Authority. Acquisitions within this category would be in accordance with funds available from year to year and from within the framewowk of the Master Plan. Emphasis would be placed on those areas which would consolidate or complete acquisition programmes for such areas as the Lower Rouge valley and the West Branch of the Humber River. C -2!. 12. IMPLEMENTATION PROCEDURES: Immediately following the signing of agreements for the carrying out of the Plan for Flood Control and Water Conservation, a set of procedures was adopted by the Authority and subsequently accepted by the Province of Ontario. These Procedures, which are summarized below, have formed the basis for the implementation of works completed to date under the Plan: Land Acquisition For approval in principle, the Authority will prepare a topo- graphic plan of appropriate scale on which are indicated the areas required for the project. The area boundaries should be approximate and should clearly indicate the relationship of the properties involved to the limits of the project, the river, its valley and flood plain. For reservoirs the plan will indicate the approximate limits of the lands to be flooded under maximum probable flood conditions. For other works such as construction areas and access areas, the limits of the land required for these purposes must be clearly indicated and covered by explanatory notes on the plan. The Authority will submit three copies of this plan to the Conservation Authorities Branch for approval, together with a request for the approval of a lump sum for land acquisition. It is the responsibility of the Authority to ensure that this sum is not exceeded without prior approval being obtained. Final approval for the purchase of each property must be obtained from the Director of the Conservation Authorities Branch when the purchase price has been agreed to and the Authority is ready to close the transaction. This form, certified by the Director of the Conservation Authorities Branch, will be produced when the Authority's claims for grant are audited. C -25 13. Contracts A. In view of the large proportion of the Plan already completed, and to avoid any confusion in administration of the programme, it is proposed to utilize those same procedures for the implementation of this Project. DETAILS OF PROJECT (b) Purpose of Project: The purpose of this Project is to enable The Metropolitan Toronto and Region Conservation Authority to complete expenditures for the Plan for Flood Control and Water Conservation within the context of the Agreement between the Province of Ontario and The Metropolitan Toronto and Region Conservation Authority for the construction of Dams; Reservoirs and Channel Improvements in the Metropolitan Toronto Region, executed on June 14, 1961, and to permit the Authority to continue the implementation of the Plan for Flood Control and Water Conservation for the region. Specifically, this Project will permit the undertaking, in the period 1971 to 1975, of the following works: - Construction of the Finch Dam and Reservoir; - Completion of Final Design Engineering for the Bolton Dam and Reservoir; - Completion of the land acquisition for the Finch Reservoir; - Completion of the land acquisition for the Bolton Reservoir; - Continue land acquisition for the Ebenezer Reservoir; - Complete the acquisition of reservoir lands for which specific commitments have been made; - Completion of Final Engineering for the Arthur Percy Dam and Reservoir; - Completion of the Final Engineering for the Snelgrove Dam and Reservoir; - Completion of land acquisition for the Arthur Percy Reservoir; - Completion of land acquisition for the Snelgrove Reservoir; - Continuation of a programme of flood plain and conservation land acquisition within the limits of the Master Plan adopted by the Authority on February 9, 1962 and approved by the Province of Ontario August 20, 1962. 14. RE: Processing of Applications for Subdivision Plans, Zoning Amendments, Official Plan Amendments, etc. C -31 Pursuant to a request from the Executive Committee for a report from the senior members of the staff regarding the processing within the Authority when subdivision plans are submitted by municipalities to better safe -guard the use of lands adjoining river valleys, the Staff have given careful consideration to this whole matter of our participation in the planning process and offer the following report for the consideration of the Board. SECTION 1 - HISTORY At the time of the formation of the Metropolitan Toronto and Region Conservation Authority, it was the practice of the Community Planning Branch (formerly Department of Planning and Development and now under the Department of Municipal Affairs) to submit drafts of Official Plans, Zoning By -laws and Subdivisions to the Conservation Branch of the Department of Planning and Development for consideration and comment. The Branch, in turn, forwarded these documents to the Field Officer assigned to the Authority to which these documents were applicable. The Field Officer was directed to prepare a report for the Conservation Branch concerning the vulnerability of the subject area to flooding or erosion and its relationship, if any, to proposed plans of the Authority. Over the years this process has become considerably more sophisticated and many matters relating to the planning process are now submitted to the Authority staff for comments and observations and these have grown to include not only the Official Plans, Zoning By -laws and Subdivisions, but Committee of Adjustment applications and, in many instances, applications for building permits. These items arrive at the Authority from a number of points of origin, including, the Community Planning Branch - Department of Municipal Affairs, the Conservation Authorities Branch, the Metropolitan Planning Department, Planning Departments of local municipalities as well as Building Departments and Committees of Adjustment, and in some instances, inquiries come directly from prospective developers prior to proceeding with formal application. The numbers of specific items to be dealt with by the Staff have been growing considerably as the years have gone by and the amount of staff time involved with each specific item has increased by virtue of the fact that no longer does the matter end with offering comments regarding a specific application, but in many instances there are follow -ups required up to and even beyond the point of issuing building permits. There are certain areas in the Region which are potentially flood - vulnerable. However, with proper channelization, a major portion of the land could be released for development. If such is the case, the developer is requested to provide detailed engineering drawings with respect to the flood control channel design. These plans are then examined by this Staff and, if satisfactory, the appropriate conditions are incorporated into the subdivision agreement with the municipality and /or the conditions of approval prior to registration of the plan. Our standard requirement is that the developer must complete all the necessary channel improvements prior to the issuance of any building permits. C -32 - 2 - At the present time, the municipalities in the Metropolitan area are engaged in preparing District Plans for their respective areas. The District Plan is a subdivision of a specific area as outlined in the Plan for the Metro Planning Area, and involves a considerable detailed land use description and designation. There are 23 Planning Districts and it is anticipated that the Staff could receive up to three draft proposals for each District prior to the final plan being approved by the Department of Municipal Affairs. The following is a summary of items dealt with by the Staff during the year 1970: Applic. TOTAL 1.860 It will be noted from the foregoing table that somewhat less than half of the applications received actually required the sending of formal replies. However, it was necessary to devote some time to a review of the specific items before a decision could be made as to whether or not a reply was in fact required. It should also be noted that the review of any applications has also required a more careful consideration in view of the fact that we no longer concern outselves just with vulnerability to flooding, erosion or conflict with a specific proposed project of the Authority. We now also must consider the relationship to the policy statement concerning Pollution Control and Recreation in the Metropolitan Toronto Region and the Design for Development concept for the Toronto - Centred Region. With the formation of the Municipality of the Region of York a similar planning under- taking may be considered. In addition, the assumption by the Authority of responsibility for the development of the Waterfront Plan has added a further aspect that must be considered in reviewing any of these matters. As of January 1, 1971, the Development Co- ordinator prepares a report on all planning matters (i.e. rezoning, etc.) pertaining to the Waterfront Study Area. A report is drafted for the signature of the Administrator of the Flood Control Division after consultation with the Waterfront Staff and forwarded to the appropriate agency which requested comments. A copy of the report is forwarded to the Director of the Waterfront. SECTION 2 - CURRENT PROCEDURES The following are the procedures followed by the Flood Control Division in dealing with any of the applications which come to our attention: 1. Each item is entered in an incoming "Mail Received Book ". 2. The item is passed to the Draftsman who immediately plots the location of the subject property against our Authority maps to determine its relationship to any of our proposed projects or policy requirements. -3 - C-33 3. Where, in fact, it would appear that an application could be in conflict with our requirements, a site visit is made by the Development Co- ordinator. 4. Following the site visit, the Development Co- ordinator will, after consultation with appropriate municipal and other officials, prepare a reply letter which is signed by the Administrator of the Division. 5. Where follow -up action is likely to be required, the file is put on a "Hold - Bring Forward" list to ensure that it is not overlooked when the appropriate follow -up action is required. The appended Flow Charts will clarify in more detail the procedures followed by the Flood Control Division. SECTION 3 - EVALUATION OF PRESENT PROCEDURES Under the present systAn, the bulk of the responsibility for ensuring that the requirements of the Authority are met, rests with the Development Co- ordinator. It can be appreciated that with nearly 2,000 applications to be processed in any given year and the multiplicity of municipalities and other agencies with whom he must carry on liaison and communication, it is inevitable that occasion- ally some item will slip by without adequate protection of the Authorityts interests being provided. These errors of omission have fortunately been very few in the past and this, in large measure, reflects the degree of co- operation that we have received from the various agencies with whom we are in contact. In most instances, in fact, points that have been missed can be directly related to a lack of information on our part because we were not informed by the appropriate municipal agency concerned. The best remedy for this particular problem, of course, is for the Development Co- ordinator to spend more time in direct contact with municipal officials. In order to achieve this, the Staff recommended the addition of a new position to the establishment to be designated "Planning Technician ". This person would be able to devote his time to many of the preliminary examinations, field visits and drafting of replies to the more routine applications and free the Development Co- ordinator to spend more time at his primary function. This position has now been approved and provided in the establishment. However, as of this date, the position has not been filled. SECTION 4 - RECOMMENDATIONS In order to ensure that the consideration of applications for Subdivisions, Zoning, Official Plan Amendments, Building Permits and Committee of Adjustment approvals is carried out in a most effective manner, the Staff offer the following recommendations: 1. That the Staff continue to increase its efforts in the matter of co- operation and co- ordination with municipalities and other government agencies and that to achieve this end, the Staff be authorized to fill the vacant position, "Planning Technicians", at the earliest possible date. 2. That the Authority continue its present efforts to co- operate with municipalities in the acquisition of lands necessary to achieving its programs and objectives. C -34 4 3. That every effort be made to obtain additional funds from senior levels of government to enable the Authority to more actively pursue its program of flood plain and conservation land acquisition. E. The firm Crysler, Davis & Jorgensen, Ltd., was authorized to carry out a preliminary engineering study of Malvern Creek running between Highway No. 401 and Sheppard Avenue in the Borough of Scarborough. The purpose of the investigation was to determine future channel capacity and erosion control requirements in the study reach. Liaison with various Authorities and field investigation of the site indicated that a major sewer construction project has severely altered the valley for about two thirds of the reach under stud:r and that a considerable change would be required in the stream channel to accommodate the upstream drainage. Consideration of the future development of the area and of the soil conditions of the site resulted in the recommendation that a channel 4.0 feet in width with 2 -1/2:1 side slopes be constructed throughout the study reach with its bottom an average of about eight feet below the existing stream channel. In addition to the channelization required for the removal of the anticipated stream flows, it is necessary to install extensive erosion control structures in the form of drops, bank lining and bottom mats to retain the new channel in its constructed position. Additional works in the form of a bridge crossing on Sheppard Avenue and a concrete entrance chute on the north side C -39 2 of Highway No. 1+01 are required to accommodate the future storm flows from the upstream area. No details are given for the Sheppard Avenue structure as this is to be constructed by others, although a recommended waterway area is enclosed. A schematic diagram of the concrete chute is also attached. C -40 I DETAILS OF PROJECT (b) Purpose of Project -3 The purpose of this Project is to enable Metropolitan Toronto and Region Conservation Authority to carry out erosion control and channel improvement measures on the Malvern Creek, a tributary of the Highland Creek, from Highway No. 401 to a location just to the north of Sheppard Avenue. Implementation of this work will better enable this water course to safely pass flood flows, greatly reduce erosion and thus the resultant silt load carried in the stream, protect a considerable public investment in trunk sewers, roads and bridge crossings and better facilitate the development of adjacent flood plain and conservation lands for public recreational uses. _ 4 I DETAILS OF PROJECT (c) Costs 1. RE: Capital Grants -- Dams and Weirs: C -45 At Executive Meeting 009/71 held Wednesday, June 9, 1971, the Executive Committee received a communication from the Minister re Conservation Grants, at which time the following resolution was adopted: "Res. #195: RESOLVED THAT: The communication from The Honourable George A. Kerr, Q.C., Minister, Energy and Resources Management, dated May 14, 1971 to the Chairman, having regard to Conservation Grants, be received; and further, THAT the following action be taken: (a) The Staff prepare a Report to the Flood Control and Water Conservation Advisory Board, with report back to this Executive; (b) The Chairman acknowledge the Minister's letter." Subsequently, the following memorandum was received from the Director of the Conservation Authorities Branch, elaborating the original announcement made by the Minister: " ONTARIO DEPARTMENT OF ENERGY AND RESOURCES MANAGEMENT Date: July 5th, 1971 MEMORANDUM: To: All Chairmen, Resources Managers, Section Heads, Secretary Treasurers From: N. D. Patrick, Director, Conservation Authorities Branch Subject: CAPITAL GRANTS -- DAMS . ND WEIRS On May 14, the Honourable Mr. Kerr advised all Conservation Authority Chairmen of a change in the system of financing projects for dams and weirs to take place effective January 1, 1971. Briefly the new system involves: 1. A grant of 75% for preliminary engineering. This is the engineering study required to define the project, assess its feasibility, and determine an estimate of the cost. 2. '1 grant of 50% for land acquisition based on the project definition provided by the preliminary engineering. 3. A grant of 50% for final engineering and construction up to the first $30,000 expenditure. 4. Full payment by the Province of the balance of the final engineering and construction cost. 5. Supplementary grants will be applicable in the case of items 2 and 3 above. (Contd Page 2) . C -46 RE: Capital Grants -- Dams and weirs: 2. In order that a smooth changeover to the new system may be effected, the following guidelines are provided: 1. Projects now underway will continue at the existing rates of grant until December 31, 1971. 2. Projects that can be finished during the current year will not be considered under the new system. 3. Projects that will continue over the changeover period (that is, completion date after January 1, 1972) will be reviewed individually, and agreements prepared to finance them under the new system starting January 1, 1972. 4. New projects will be initiated under separate individual agreements between the 'Authority and the Minister. The steps to be followed in initiating a project under the new system are as follows: 1. Decision by the Authority to investigate a potential project. 2. Request in the normal manner for approval and grant for preliminary engineering. 3. Review and approval of preliminary engineering report bt Authority and Branch staff. 4. Formal request by 'Authority to the Minister to enter into an agreement for the project. 5. Discussions and negotiations between the 'Authority and Branch Staff to determine details of the agreement with respect to time schedules etc. before agreement finalized. 6. Project proceeds. I would request that your Authority now review its total programme in the light of these changes. It is intended that the traditional budget review will be replaced by a programme review during the fall and early winter. For this to be effective, it is essential that each Authority prepare a long range plan covering the next five years as a minimum and where large projects are involved, an extension of the plan up to ten years. Patrick The Staff has reviewed this material in relation to the Authority Programme for Flood Control and Water Conservation and would report as follows: SECTION I -- BACKGROUND: : 11 In 1961, the .'Authority entered into agreements with the senior governments for the implementation of a comprehensive Plan for Flood Control and Water Conservation. Included in the Plan was a proposal (Contd Page 3) C -47 RE: Capital Grants -- Dams and Weirs: 3. to construct the following dams: Watershed ,Structure Etobicoke Creek Snelgrove Humber River Claireville Ebenezer Bolton Nashville King Creek Boyd Don River F inch -7illo \;dale Highland Creek West Hill Rouge River Milne Duffin Creek Clarkes Follow Arthur Percy The original Plan anticipated completion of all works within a 10 year period, that is by June of 197; however, greatly increas :d costs of both land and construction precluded the meeting of that target, and the Authority has subsequently adopted Project N.C. -63 - "A Project for the Extension of the Plan for Flood Control and Water Conservation ", which envisages the implementation of further work from within the original Plan for the 5-year period 1971 - 1975 inclusive. It is acknowledged that W.C. -63 will not enable the completion of all the originally proposed -.corks, and a further review has been proposed to explore the means of completing the remaining structures in the period after 1975. The new assistance programme of the Province of Ontario for the construction of small dams and weirs, utilised in conjunction with W.C. --63, will enable substantially greater progress for the period 1971 - 1975 and considerably reduce the time period involved for the ultimate completion of all the works contained in the original Plan. SECTION II -- PROGRESS TO DATE: The following is a summary of the status of the various dams proposed under the Plan for Flood Control by project: Snelgrove Dam & Reservoir: - Property: 111 acres purchased of the total estimated requirement of 303 acres; completion of land acquisition is proposed under W.C. -63; - Preliminary Engineering: complete; - Final Engineering: proposed to be undertaken within the framework of W.C. -63; - Construction: has not been scheduled at this time; (contd Page 4).
