Lemon RESOLVED THAT: The Report of the Sub- Committee on Roadside Plantings be received; and further THAT the Staff be directed to prepare information for municipal - ities to assist them with design and materials for roadside plantings. Fair RESOLVED THAT: The Report of the Milne Reservoir Management be received. CARRIED UNANIMOUSLY; APPOINTMENT OF MEMBER A communication was presented advising that Mr. B. Thompson of the Department of Lands and Forests has replaced Mr. J. Christian as Zone Forester. Res. #5 Moved by: R.L. Nesbitt Seconded by: G. Lowe THE BOARD RECOMMENDS THAT: Mr. B. Thompson, Zone Forester, Depart- ment of Lands and Forests, be appointed a member of the Reforestat- ion and Land Use Advisory Board. CARRIED UNANIMOUSLY; FARM ASSESSMENT & TAXATION Mr. McLean presented a brief summary of the Report on Farm Assessment and Taxation and suggested that some action *tight be considered by the Board. Lawrie RESOLVED THAT: The Staff prepare a communication on the Report on Farm Assessment and Taxation, for consideration by the Executive Committee; and THE BOARD RECOMMENDS THAT: Representation be made on the recommend- ations contained in the Report - Farm Assessment and Taxation, to the Department of Municipal Affairs,. supporting the recommendations of the Report on Farm Assessment and Taxation. Lowe Meeting #1/70, as presented, be CARRIED UNANIMOUSLY; STAFF PROGRESS REPORT Mr. J.D. Agnew presented a Staff Progress Report which was discussed in detail. Res. #8 Moved by: F.R, Perkins Seconded by: G. Gardhouse RESOLVED THAT: The Staff Progress Report for the period to date be received. CARRIED UNANIMOUSLY; E -5 -2- REPORT RE FIREWOOD PROGRAMME The Staff presented a comprehensive report on the Firewood Programme. Res. #9 Moved by: H.E. Kennedy Seconded by: E. Lemon RESOLVED THAT: The Staff Report on the Authority's Firewood Programme be received and appended as Schedule "A" of these Minutes; and further THE BOARD RECOMMENDS THAT: The Authority continue its Firewood Sale Programme and that the proposed price increases, as outlined in the report dated September 22, 1970, be implemented as of October 1, 1970. CARRIED UNANIMOUSLY; AUTHORITY FOREST AGREEMENTS The Staff presented a draft of the proposed new Agreement Form with the Department of Lands and Forests having regard to the Authority's Forest Agreements. Res. #10 Moved by: E. Lemon Seconded by: F.R. Perkins RESOLVED THAT: The draft of the proposed new Agreement Form with the Department of Lands and Forests having regard to the Authority's Forest Agreements be received and appended as Schedule "B" of these Minutes; and THE BOARD RECOMMENDS THAT: The proposed Agreement Form as submitted by the Department of Lands & Forests having regard to Forest Agreements be adopted; and further THAT existing Authority forest lands be placed under the new Agreement when it becomes available. CARRIED UNANIMOUSLY; REPORT RE FARM ASSESSMENT & TAXATION A recommendation of the Reforestation and Land Use Advisory Board, which reads: "Representation be made on the recommendations con - tained in the report Farm Assessment and Taxation to the Department of Municipal Affairs supporting the recommendations of the report on Farm Assess- ment and Taxation. o• - was considered at Meeting #4/70 of the Authority and was referred back to the Board for further consideration. Considerable discussion took place on the matter. Res. #11 Moved by: G. Gardhouse Seconded by: H.E. Kennedy RESOLVED THAT: The Report on Farm Assessment and Taxation be the subject of a special meeting of this Board; and further, that the following action be taken: (a) Copies of the Report be made available to all members of the Board prior to the meeting; and (b) The Minister of the Department of Municipal Affairs be requested to have a representative of the Committee responsible for the preparation of the Report attend the meeting. Higgs, Director of Operations Chairman Acting Secretary E -7 SCHEDULE "A" To: Reforestation & Land Use Advisory Board Re: Firewood Program For the past eight years the Authority has sold firewood obtained from woodlot management and elm removal projects. Lately the bulk of this wood has come from the elms. The main purpose in establishing wood sales was to obtain some financial return for the work involved and to make use of a resource. Considerable quantities of firewood are also required in the Conservation Areas for camps and special programs. By making wood available to the public at our campsites, the risk of damage to trees and woodlots has been reduced. At the present time most of the Conservation Areas are selling firewood and have established a large number of steady customers. In 1969, 1871 cords of firewood were sold, resulting in an income of $5705.00 plus $456.00 for delivery, for an average return of approx. $33.00 /cord. This income was about 1/3 of the amount spent on elm removal and wood - lot management. The production and delivery of firewood involves costs over and above those which would normally be incurred in the removal and disposal of trees. The following are the extra costs involved based on 1970 labour rates. Production - 4 man hrs /cord 0 $3.00 /hr $12.00 Delivery - g man hrs /cord c $3.00 /hr $24.00 - Truck 0 $.20 /mi. (40 mi. /cord) $ $.00 $44.00 At our current costs and wood prices established in April 1967, an average loss of $11.00 /cord will result. At present our prices are considerably below the going rate for firewood within the region. If we are to avoid seriously undercutting private enterprise and prevent the program operating at a loss, a price increase is necessary. SCHEDULE "B" AGREIMENT made this day of 19 pursuant to The Forestry Act and The BETWEVN: E -$ THE MINISTER OF LANDS AND FORESTS for the Province of Ontario, herein called "Minister ", AND herein called WHEREAS the parties hereto have previously entered into an agreement whereby the Minister agreed to manage for forestry purposes lands acquired by AND WHEREAS The Forestry Amendment Act, 1967 re- defined the term "forestry purposes" to include the production of wood and wood pro- ducts, provision of proper environmental conditions for wild life, protection against floods and erosion, recreation, and protection and production of water supplies: AND WHEREAS the parties hereto desire to terminate and replace the said agreement with these presents made under section 2 of The Forestry Act as amended; NOW THEREFORE this agreement witnesses that in considera- tion of the mutual promises, covenants, agreements and undertakings herein contained the Minister and agree each with the other as follows: 1. The does hereby demise and lease unto the Minister the lands, hereinafter referred to as the "Forest Area ", described in Schedule "A" for the term of yearn commencing with the day of , 19 2. Provided that moneys are appropriated therefor by the Legisla- ture of Ontario, the Minister agrees, 3. E -g - (a) to manage the Forest Area for the forestry purposes agreed upon by the Minister and (b) to furnish such equipment, plant such trees, erect and maintain such fences, structures, buildings and improvements and do such other work that may in his opinion be required in connection with the management of the Forest Area; and (c) that the costs incurred in the management of the Forest Area will be borne by the Minister. The agrees that the Minister during the term of this agreement or any renewal thereof may sell, lease or otherwise dispose of the trees or products therefrom, structures, buildings or improve- ments now or hereafter growing or erected on the Forest Area, and shall be entitled to the revenues derived therefrom. 4. (1) The Minister agrees to furnish a report to the within twelve months after the termination of each year of the term of this agree- ment or any renewal thereof, setting out the expenditures made, the revenues received, the work done in respect of the Forest Area during the year covered by the report and the work, with estimated coats and revenues, proposed to be done in the year following the year reported. (2) In this paragraph the word "year" means a period commencing with the let day of April and ending with the 31st day of March next following. (3) The Minister and agree to hold meetings from time to time to discuss rnatters arising under this agreement. 5. Where the , with the written approval of the Minister, sets apart any additional land or acquires any additional land for the purpose of this agreement and files with the Minister proof of ownership satisfactory to the Minister and a lease in quintuplicate of the land substantially in accord with Schedule "B ", (a) Schedule "A" shall be deemed to be amended to include the land so set apart or acquired; and (b) the Minister may make a grant out of the moneys 6. E -10 appropriated therefor by the Legislature of Ontario to the for the purpose of assisting it in the acquisition of the land of an amount to be determined by the Minister but not exceeding ?5% of (i) the purchase price paid by the for the land, and (ii)' the solicitor's fees and disbursements paid by the to secure title to the land in its name. In the event the Minister and agree to terminate this agreement in respect of any part of the Forest Area, the agrees to pay to the Minister the expenses, with- out interest, determined by the Minister to have been incurred in managing such part of the Forest Area after deducting therefrom the revenues, without interest, determined by the Minister to have been received from the management of such. part of the Forest Area provided that in the event the said revenues exceed the said expenses, the Minister agrees to pay the excess to the provided that moneys are appropriated therefor by the Legislature of Ontario. 7. The Minister agrees that the may make payments to the Minister from time to time in respect of the costs incurred by the Minister in the management of the Forest Area, and that such payments will be deemed to be revenues received by the Minister in the management of the Forest Area. 8. The agrees that the Minister may make payments to the from time to time in respect of the revenues received by the Minister in the management of the Forest Area and that such payments will be deemed to be costs incurred by the Minister in the management of the Forest Area. 9. (1) The agrees, during the last twelve moths of the term of this agreement, to select one of the three options herein - below set forth to take effect upon the expiry of the term of this agreement. (2) The agrees to advise the Minister in writing of the selection made pursuant to subparagraph 1 before the expiry of the E -11 - 4 term of this agreement. (3) In the event the fails to comply with subparagraphs 1 and 2, the shall be deemed to have selected Option 3 for a period of twenty years. OPTION l: The shall pay to the Minister the amount without interest of the costs incurred by the Minister in connection with the management of the Forest Area after deducting therefrom the an_o..nt without interest of the revenues received by the Minister in connection with the manage- ment of the Forest Area provided that in the event the said revenues exceed the said costs the excess will be paid to the OPTION 2: The shall grant the lands in the Forest Area to Her Majesty the Queen in right of Ontario as represented by the Minister of Lands and Forests, in fee simple, free from encumbrances and shall execute a conveyance of the lands in the Forest Area upon payment by the Minister to the of the purchase price paid by the for the lands in the Forest Ares, OPTION 3: The may extend the term of this agreement for a period of not less than twenty and not more than fifty years. 10. The Minister and agree that this agreement and any lease filed with the Minister under paragraph 5 shall be registered in the proper registry or land titles office in accord with The Forestry Act. 11. The Minister and agree that any dispute as to the true intent and meaning of this agreement may be referred to arbitration under The Arbitrations Act provided that no such reference shall be made unless 60 days' written notice is given by the party intending to make s,tch reference to the other party to this agreement. Lowe THE BOARD RECOMMENDS THAT: Recommendation 2 :7 in the Report of the Committee on Warm Assessment and Taxation - Ontario, which reads: -3- E -15 "Forest land be assessed on the basis of a soil capability schedule which reflects the value of land for forestry purposes as soon as such a schedule can be developed and that the resultant tax base be the maximum tax base for forest land. Implicit in ail our recommendations respecting the assessment of farm land is the presumption that all property is assessed at market value. The Committee is aware that market value assessments for all properties in the Province may be as much as five years away. Until the assessments at market value are made it could be inequitable in the extreme to implement our recommendations respect- ing farm assessments if they served to raise farm assessments without corresponding increases in non -farm assessments. There are, however, a number of municipalities in which non -farm assessments are based on market value and the farm assessments on section 35(3) of The Assessment Act.
