Honsberger RESOLVED THAT: Report No. 4 of the Executive Committee be received, and the recommendations contained therein and set forth herein, be adopted: GENERAL ADMINISTRATION: 1. Borrowing Resolution - 1964 (a) That the Chairman or Vice - Chairman and the Secretary - Treasurer and /or Deputy Treasurer of the Metropolitan Toronto and Region Conservation Authority are hereby authorized to borrow from time to time, by way of promissory note, from the Royal Bank of Canada, Woodbridge Branch, the sum or sums not exceeding $4,000,000.00 to meet immediate administrative expenditures until the Province of Ontario Grant and sums levied against the participating Municipalities have been received, and to give, on behalf of the said Authority, a promissory note or notes, sealed with the Corporate Seal, and signed by the Chairman or Vice- Chairman and the Secretary- Treasurer and /or Deputy Treasurer, for the monies so borrowed, with interest which may be paid in advance or otherwise, at a rate not exceeding 5i per centum per annum. (b) That all sums borrowed pursuant to the Authority of this Resol- ution, for the purposes mentioned herein shall, with interest thereon, be a charge upon the whole of the monies received, or to be received, by the said Authority, as and when such monies are received. (c) That the Secretary - Treasurer and /or the Deputy - Treasurer is hereby authorized and directed to apply in payment of all sums borrowed as aforesaid, together with interest thereon, all of the monies hereafter collected or received by thq said Authority from the Province of Ontario, by way of a Grant, or from the participating Municipalities pursuant to a levy to be made in accordance with the provisions of The Conservation Authorities Act, 1960, as amended. 2. Signing Officers Subject to the provisions of the Conservation Authorities Act, all deeds, transfers, assignments, contracts and obligations on behalf of the Authority may be signed by the Chairman or Vice - Chairman, and by the Secretary - Treasurer or Deputy Treasurer, and the Corporate Seal shall be fixed to such instruments as require the same. 7- A -7 3. Appointment of Auditors That Clarkson, Gorgon & Company be re- appointed as Auditors of the Authority for the year 1964. 4. Appointment of Solicitor That D.R. Walkinshaw, Q.C., be re- appointed as Solicitor to the Authority for the year 1964, and that his retainer fee be on the same basis as in previous years. FLOOD CONTROL & WATER CONSERVATION: 5. Acres Report re Study of Mimico Creek Watershed: That the preliminary engineering report, s ?A Study of the Mimico Creek Watershed, as prepared by H.G. Acres and Company Limited, be approved in principle, and that the following action be taken in this regard: (a) Copies of this report be forwarded to the Conservation Authorities Branch, Ontario Department of Lands and Forests, for approval; (b) Copies of this report be made available to the Municip- alities of Toronto Township and Metropolitan Toronto for their consideration; (c) With regard to the specific recommendations contained in this report, the following policy be adopted: i) The hydrology be reviewed in detail for individual projects as they are undertaken, in order to take advantage of additional data which will become available; ii) The Staff be instructed to strictly enforce any and all Authority Regulations relating to the dumping of fill or erection of structures within estimated flood lines as shown on Plates 11 to 24; iii) Before local channel improvement works are under- taken in the Queensway area, that further study be given the economic feasibility or the desirability of acquiring the lands and removing the buildings considered to be flood vulnerable; iv) Before channel improvement works are undertaken in the vicinity of Dundas Street, the Consultant be requested to advise the Authority whether or not some alternative structure might be employed which, while adequate, would be less costly; v) The channel improvement works for the Royal York Road area and the Village of Malton be undertaken as recommended, vi) The recommended channel improvement in the Disco Road area, while necessary,be considered to have a low priority; vii) Flood control by means of reservoir for the Mimico Creek Watershed be ruled out as economically un- feasible; viii) No further consideration be given to the suggested diversion of the flow from the Humber River; (d) A program of flood control for the Mimico Creek Water- shed be undertaken on the basis of the findings of the Acres Study, as funds can be made available. A -$ -$- 6. Preliminary Property Plan - Boyd Dam & Reservoir That the Preliminary Property Plan for the Boyd Dam and Reservoir, dated January, 1964, be approved as presented, and further in this connection, the following action be taken: (a) That the Plan be submitted to the Conservation Authorities Branch, Ontario Department of Lands and Forests, for approval; b) That when the necessary approval has been received, the Staff be authorized to proceed with the acquis- ition of the lands designated in this Plan under the provisions of the Conservation Authorities Act. ( CONSERVATION AREAS 7. Regulations Concerning the use of Conservation Areas That the regulations concerning the use of Conservation Areas be amended as follows, by adding: Section 17 - ii (e) 'operate a motorized prop,lled unit in the class of Snow - Mobiles, motorized Toboggans, etc., in any Conservation Area, except under permit issued by the Secretary- Treasurer". Carried Unanimously; VOTE OF APPRECI!1TION: At the request of Mr. Wade, the Chairman left the Chair, and Mr. Walkinshaw resumed the Chair briefly. Carried Unanimously; BRIEF TO THE ROYAL COMMISSION ON METROPOLITAN TORONTO: Mr. Pind brought up certain items in the Brief approved by the Executive Committee to The Royal Commission on Metropolitan Toronto, having regard to the matter of Regional Planning, and requested that the Executive re- view the said Brief at its next meeting, before presenting it. Lunn (nairman Secretary- Treasurer SCHEDULE "A" METROPOLITAN TORONTO & REGION CONSERVATION AUTHORITY REPORT OF THE CHAIRMAN TO THE ANNUAL MEETING February 7, 1964 GENERAL: A -9 Your Authority has completed seven years of operation. I believe that you should feel some pride in what has been accomplished. Land acquisitions have grown from 1,800 acres in 1957 to over 13,500 acres in 1963. The Conservation Areas -- now numbering nine open to the public -- comprising of some 4,300 acres, attracted 157,000 persons in 1957 and in 1963 the attendance for the first time topped the one million mark. The Flood Control Plan, launched in 1961, afte,the signing of the Agreements between the Federal and Provincial Governments and the Authority, is now well under way. The Claireville Dam will be completed by the Summer of 1964 and many other projects are either completed'or progressing favourably. The Pioneer Village has already become an oustanding attract- ion for tourists and school children -- the attendance during 1963 being 159,000 including 22,000 children in school classes. The Conservation School at Albion Hills is completing a most gratifying first year of operation. School Boards have reserved time for the entire academic session and the 1964 -65 session is almost completely booked up at this date. The School has already proven itself to be a fine addition to our facilities. It is a beautiful building and at the same time efficiently functional. It is attracting a great many groups for week -end activities and it is hoped that various organizations will make use of the facilities during the Summer months. Our public relations continue to be excellent. The press, radio and television have continued to give us excellent publicity. Television shorts, illustrating the Winter activities in the Areas, have been a welcome part of this campaign in 1963. I would strongly suggest that we cannot take our good publicity for granted. As we grow in size and in activities, we come in contact with and affect more and more people. Not all of our contacts are without some irritation on the part of the public. It is therefore imperative that each member of the A -10 - 2 - Authority consider himself to be a good -will agent and in all his contacts attempt to explain our objectives and hopes. In this way, many possible sources of friction can be cleared up before they grow into major issues. I would appeal to each of you to increase your own public relations efforts on behalf of the Authority. Very few people would criticize you for enthusiasm in this regard. The Conservation Services work of the Authority has continued to expand. During the year, 337,000 trees were planted. The Farm Tree Replacement Programme handled 3,000 trees; and 25 farm ponds have been built in 1963. The Metropolitan Toronto and Region Conservation Foundation has continued its worthwhile endeavours under Chairman Fred A. Wade. Its first major project, the Conservation School, is acclaimed as an oustanding success. The Foundation has raised nearly $100,000. to date towards the financing of the cost of construction of the School. The Staff of the Authority continues to prove that it can grow in stature as the Authority grows. Our Secretary- Treasurer, Fred Lunn, and Director of Operations, Kenneth Higgs, with their capable Staffs, have been able to meet every ordinary, and each emergency demand, of a very dynamic organization. On your behalf, I would thank the Staff for their loyal and effective perfb rmance during 1963. The Authority and its many Committees have been active, as usual, during the year. There have been four meetings of the Authority. 23 meetings of the Executive Committee, and 62 meetings of the Advisory Boards, Sub - Committees and special Committees. Some 92 people attended one or more of $9 meetings. The Authority membership now stands at 55, 26 being appointed by Metropolitan Toronto, 26 by the other municipalities, and three by the Lieutenant - Governor -In- Council. It is a pleasure to again acknowledge the generous support accorded me by Mr. William Davidson, Q.C., Authority Vice - Chairman. To the Executive Committee of the Authority, we again express our sincere thanks and appreciation for their diligent attention to our/ affairs during 1963. 3 A -11 WORK OF THE YEAR: Conservation Areas: During the year, schemes were initiated to increase the holdings in the Conservati ^n Areas by 525 acres. In addition to the Areas mentioned above, the Authority owns and manages the following: Brucevs Mill Glen Major Uxbridge Falgrave Forest & Wildlife Conversation Area Three other Areas -- Bolton Community Conservation Area, Oakbank Community Wildlife Area and the Humber Forest -- are owned by the Authority but under Agreement with other agencies for management. There are a total of 7,237 acres of conservation lands acquired in addition to the lands being acquired under the Flood Control sd1 eme. Development has taken place in most of the Areas during the year. The Heart Lake Centre building was extended by adding a service wing. At Albion, a water system has been designed, a bridge built over Centerville Creek and improvements carried out on the School Farm. The bridge and access road has been completed at Claremont. At Black Creek, the Superintendents House was finished and a start made on the Village Flour Mill. The dam and pond at Brucevs Mill were started in November. A -12 - 4 - The pavilion and grounds at Woodbridge Area are in readiness for the Spring festivities. Flood Control: The Flood Control work is proceeding as quickly as funds and engineering designs permit. The Claireville Dam, under construct- ion since last Fall, has $0% of its concrete and 40% of its earth placement completed. The dam construction is well ahead of schedule and should-be finished by August 1964. The Indian Line Road 4iversion for this project has been completed and the contract for the Steeles Avenue bridge has been awarded and work commenced. On the Black Creek, the channel from Scarlett Road to Rock - cliffe Blvd. is completed, and the sections from Rockcliffe Boulevard to Louvain Street and from Queens Drive to Rustic Road will be commenced this Spring. A number of engineering studies have been completed, namely: - Report on the Snelgrove Dam on the Etobicoke; - Scheme for Main's Creek in Brampton; - Report on the Main and East branches of the Humber; - Study of the Don Watershed; - Study of Duffin's Creek; - Highland Creek Channel Improvements; - and - - Massey Creek Channel Improvements. The contract drawiro for the York Mills Channel Extension are nearing completion and property acquisitions are being negotiated. A major part of the work in the Flood Control Programme has been the necessary acquisition of property for reservoirs1 dams and flood plains. Our Property Division has been kept extremely busy on the work as will be indicated by the following brief summary. A. B. Federal - Provincial - Authoritv Participation Projects: In 1963 -- $4 properties -- 1,538.634 acres Total to date -- 195 properties -- 2,7$$.173 acres; Provincial- Authority Participation ProJects: In 1963 -- 123 properties -- $$2.9$0 acres; Total to date -- 199 properties -- 2,187.373 acres; - 5 - C. Water Control Schemes: In 1963 -- one property -- 29.867 acres; Total to date -- 188 properties -- 1,293.044 acres; Grand Total Flood Control Acreages Acquired: In 1963 -- 2,451.481 acres; Total to date -- 6,268.590 acres; Conservation Services: A significant contribution of the Conservation Services Divisio this year was the preparation and presentation of the Brief on Recreation and Water Pollution in the Metropolitan Toronto region. This Brief studies in detail the factors contributing to the pollution of our rivers and recommends a plan which, if followed, will reserve certain areas from pollution for years to come. The Report, already approved by the Authority, has been presented to the Metropolitan Toronto Planning Po=d and will be presented to other area boards and councils in the next few months. The Staff has planted 150,000 plantation trees; 1,550 landscape trees; and 31,358 shrubs on our own Areas, and 187,000 trees on private lands. The Farm Tree Replacement Programme is in full stride -- 1,640 trees having been planted for 23 owners. In the operation of certain of our own lands -- 160 acres of hay, 90 acres of wheat, have been harvested. A forestry Woodlot Manage- ment Programme on Authority lands yielded 320 cords of firewood and 44,761 fbm of sawlogs. In addition, diseased elms were removed from Areas and the usual spraying carried out. Turf Management and Stream Improvement projects have been continued. Subsidies were paid on 25 completed farm ponds, and the Staff gave technical advice in over one hundred farm pond inquiries. A new publication for the purpose of informing landowners of our Conserv- ation Service Programme, known as "Conservation News" was printed and distributed to eight hundred owners. Information and Education: In this Division of our work, the oustanding event during 1963 was the completion of the Conservation School at Albion Hills. The School opened for its first class on September 16th, and was officially opened A -13 A -14 -E - by the Honourable Wm. A. Davis, Minister of Education, on October 23rd. The School was open to the public on October 13th and 14th, and two thous- and interested citizens attended. Over two hundred secondary school principals and friends visited the School on November 24th and December 1st. The School is now well into the Spring Term with every week booked by area school boards. School Supervisor, Jim Malcomson, Assistant Supervisor, Terry Carr, and Naturalist, Ken Strasser, have successfully launched the School on a firm Conservation Programme. The other special occasion meriting mention was the Official Ground - breaking Cer' '^ "y on June 13th at the Claireville Dam. The Honourable A. Kelso Roberts and Honourable Arthur Laing officiated. The ground was broken by a dynamite blast, set off by the two Ministers at the appropriate moment. Four hundred invited guests enjoyed the Programme and refreshments in perfect weather. The Authority held a very successful Conservation Workshop at the Canadiana Motor Hotel last Spring with 212 registered participants. Many Chairmen and members of other Authorities came from as far away as Sudbury. It is proposed to hold a similar Workshop again in two years time. Five Fireside Nights were held in Conservation Areas, with 1,500 attending. School Nature Hikes in Areas were attended by more than 6,200 children. The Pioneer Village Conducted Tours accommodated 22,000 school children and 1,$00 adults. Press, radio and television have continued to give the Authority excellent coverage. There were over seventy radio announcements and 25 television interviews during the year. Members of the Authority and the Staff, gave over sixty lectures and our films and slides were used extensively. Some 49 prints of the film "Pioneer Village at Black Creek" have been sold to other agencies. Historic Sites: The Authority prepared and presented a Brief to the Government of Ontario asking for funds for the Pioneer Village as a Centennial project under the Federal- Provincial Scheme of Grants. We have been informed that the Authority does not qualify for a grant, since under the Provincial Bill, grants may only be made to municipalities. We still - 7 - A -15 hope that some way may be found to permit the Village to be supported from the Centennial funds. During the year, a Harness Shop, a Boot & Shoemaker's Shop, and a Carriage Shed were completed. A Bake -Oven was also obtained and anstructed. The machinery and timbers of a Flour Mill at Ameliasburg, Ontario, were dismantled and brought to the Village. A Flour Mill for the Village has been designed and the foundation completed. In order to beautify the Village, a programme of planting larger trees has been initiated. Eighteen large trees were planted in 1963. For fire- protection, a fire -truck of 1942 vintage was procured. The attendance at the Village has continued to grow. School classes including 22,000 children filled all available Guided Tours. The total attendance at the Village during the year was 159,000 persons. The Foundation: The Metropolitan Toronto and Region Conservation Foundation has beccme a force of growing importance in the Conservation picture. Having already raised the sizable sum of nearly 100,000. for the gonservation School, it is pressing on to even more significant endeav- ours. More and more organizations and individuals are realizing that the Foundation is the vehicle through which donations and bequests may be made to further some desirable feature of Conservation growth. The School project served to show all of us what can be done when the vehicle is there, and the project is right. Mr. Fred A. Wade, Chairman, and hisfellow members of the Foundation, deserve our thanks and best wishes in their fine work. THE FUTURE: Last year I said that we were well launched on the Flood Control Programme. The Programme has been considerably advanced during the year, The Claireville Dam will be completed during the Summer of 1964. The Black Creek work is advancing with two contracts completed and another ready for tender. The York Mills Channel should be constructed this Summer. Our land acquisitions for Flood Control have reached 6,300 acres. This land is being acquired as fast as funds will permit. In my Report one year ago, it was stated that pollution of our rivers must be attacked in a more vigorous fashion. I am happy to say A-16 - $ - that the Authori ty has taken the first major step in this direction, by the production of its Report on Recreation and Pollution Control in the ,area. This Report lays out a working plan, which, if followed, will_enable us to conserve certain waters from creeping pollution for a few decades at least. In my opinion, the Report is a forthright attempt at the solution of what many thought to be an almost unsolvable problem. It is my sincere hope that all planning boards and municipalities ih our area will adoptthe Plan this year. Last year, I mentioned that an Advisory Committee and Technical Committee to deal with lakeshore development and erosion control had been set up. The Committees are Sub - Committees of the Metropolitan ' planning Board. Your Director of Operations, Mr. Kenneth Higgs, is a member of the Technical Committee, and the Chairman of the Authority is Vice - Chairman of the Advisory Committee. Consultants have been appointed and they are at work in the preparation of a comprehensive report on the lakefront. OUR PARTNERS IN CONSERVATION WORK: As we all know, the 23 municipalities in our area make it possible for us to carry on our work. It is they who supply one half of the money needed for Conservation. I have often said that there is nothing sadder than a Conservation Authority with work to do and wittaout funds to do it. Fortunately, the municipalities and our other partner, the Province of Ontario, have continued to give us the support we need to do the job. You will all have heard that after two very satisfactory, years working with the Departmnt of Lands and Forests under the Honourable A. Kelso Roberts, Q.C., the Conservation Branch is to be transferred about April 1st, 1964, to a new Department -- the Department of Energy and Resources Management. The Minister will be the Honourable J. R. Simonett. We look forward to the same cordial relations with the new Department that we enjoyed under the old. In this Regulation: (a) "Authority- means the Metropolitan Toronto and Region Conte^ ation Authority; (b) "building" or "structure" means building or structure of any kind; (c) "fill" means fill of any kind. 2. The areas defined in the Schedule are designated as areas in which, in the opinion of the Authority, the control of flooding or pollut- ion or the conservation of land may be affected by the placing or dumping of fill. 3. Subject to Section 4, no person shall: (a) construct any building or structure or permit any building or structure to be constructed in or on a pond or swamp or in any area below the high -water mark of a lake, river, creek or stream; or (b) place or dump fill or permit fill to be placed or dumped in the area designated in the Schedule; 4. Subject to The Ontario Water Resources Commission Act or to any private interest, the Authority may permit in writing the construct- ion of any building or structure or the placing or dumping of fill in any area to which Section 3 applies if, in the opinion of the Authority, the site of the building or structure or dumping and the method of the construction or dumping would not affect the control of flooding or pollution or the conservation of the land. 5. No person shall begin to construct any building or structure or dump dump or place fill in any area to which Section 3 applies before the permission required by Section 4. has been obtained. 6. (2) A signed application for permission to place or dump fill shall be filed with the Authority and shall include: (a) four copies of a plan of the property on which the fill is to be placed, showing the proposed location of filling, the depth to which it is proposed to fill, and the proposed final grade of the land when filling is completed; (b) four copies of a complete description of the type of fill proposed to be placed or dumped; (c) four copies of a statement of the dates between which the _ placing or dumping will be carried out; and ,(d) four copies of a statement of the proposed use of the land following completion of placing or dumping. 7. The Authority may, at any time, withdraw any permission given under Section 4 if, in the opinion of the Authority, the representations contained in the application for the permission, and amendments thereto, are not carried out. $. (c) The present workshop and service area be re- located, in conformity with the Master Plan; (d) The outdoor theatre be re- located to conform with the Master Plan; (e) When the Village Flour Mill building and ponds have been constructed, consideration be given to using the pond areas for skating; (f) The Staff be authorized and directed to enter into negotiat- ions with the Townships of North York and Vaughan for an agreement to construct an underpass linking Authority lands north and south of Steeles Avenue, to conform with the proposal in Section C of the Master Plan; (g) In the event that a collector road, as is presently requir- ed by the North York Traffic Department, and indicated on the Master Plan, becomes a reality, the criteria outlined in sections D and E of the Master Plan be the requirements of the Authority; (ii) Scheme CA -41 - Glen Major Extension That Scheme CA -41, A Scheme for the Extension of the Glen Major Conservation Area, be adopted; and further in this connection, the following action be taken: (a) All member municipalities be designated as benefitting; (b) The Minister of Energy & Resources Management be requested to approve this Scheme, and a grant of 50% of the cost thereof; (c) When approved, the appropriate Authority officials be authorized to take whatever action is required in connect- ion with the Scheme, including the execution of any neces- sary documents; Committee of the County of Ontario; and A -54 -6- (i) Ontario County ARDA Committee - Appointment (contfd) further that he be paid per diem and mileage when attending meetings of the said Committee; (ii) Streambank Erosion Control Assistance Program That the recommendations contained in the Stream Bank Erosion Control Assistance Programme Sub - Committee Report, as outlined below, be adopted: (a) To protect the quality of water in Authority Reservoirs and reduce siltation within Reservoirs, the Authority should develop a realistically strong Programme to assist private landowners in combatting streambank erosion; (b) The complete Assistance Programme should be restricted to owners of watercourses above Authority Reservoir sites; (c) Technical assistance will be provided to landowners below Reservoir Sites, which may include recommending that the private landowner obtain professional engineering service; (d) Since the limited loss of soil from the banks of streams is of minor concern to most landowners and because often little more than aesthetic benefits will be gained by co- operating landowners, the Authority should finance streambank erosion control; the landowner could be required to protect the projects from damage by livestock by installing a suitable temporary or permanent fence -- some assistance towards the fancing likely should be provided by the Authority; (e) Streambank erosion control projects should be planned and developed as attractive and well designed assets to rural properties; The use of large ponds in streambank erosion control (through reducing run -off and peak flows) as well as for agricultural water supplies should be considered in the Authority's proposed programme under A.R.D.A.; Three pilot projects should be carried out in 1964 in co- operation with private landowners; the Authority should finance streambank erosion control, while each landowner should agree to allow demonstration of the project; (h) Regulations for the streambank erosion control assistance programme should be drafted following the completion of these and possibly other pilot projects; (iii) Farm Plan Assistance Programme - Amendment That the Farm Plan Assistance Programme be amended as set forth herein: (f) (g) (a) The addition of the wording to be improved for growing of farm crops" to the Farm Plan Assistance Programme Regulations; (b) By the deletion of the words "100 acres, or fraction thereof", from the Tile Drainage & Grassed Waterway Assistance Programmes, to avoid confusion in interpretation, and align these two with Regulations under the Farm Plan Assistance Programme; (iv) Advisory Board - Appointment of Member That Mr. M.G. PURPOSE OF THIS REPORT: On the 14th day of June, 1961, Agreements were executed between the Government of Canada and the Province of Ontario and the Metropolitan Toronto and Region Conservation Authority for the implementation of a comprehensive Plan for Flood Control and Water Conservation in the region under the jurisdiction of the Authority. Shortly after the signing of these Agreements, a proposed Project Scheduling Programme was considered and adopted by the Authority which envisaged completion of the works in the period of ten years. As time has passed, it has become necessary - for a number of reasons - to abandon the original project scheduling in order to meet more realistically, the exigencies of the day. Now - some three years later - it has been deemed advisable to present this comprehensive report on the status of the Authority's 'Plan for Flood Control and Water Conservation. Following are the specific purposes of this report: - (a) to review the Plan for Flood Control and Water Conservation and how it came into being; (b) to present a comprehensive progress report on the Plan; (c) to outline additional works required which were not included in the original Plan; (d) to make recommendations pertaining to the revised project scheduling and financing; A -64 - 2 - II. REVIEW OF THE ORIGINAL PLAN: The year 1954 was a significant one in the Metropolitan Toronto region from the point of view of flood control and water conservation for two very important reasons. The first of these was the establishment of the Municipality of Metropolitan Toronto. This provided the atmosphere and the political base for the amalgamation of four River Valley Authorities -- the Etobicoke - Mimico, Humber, Don, and R.D.H.P. -- into a regional Authority to undertake conservation work for the whole area on an integrated and comprehensive basis. The second was the onslaught of Hurricane Hazel, which in the two days October 14th and 15th, took a toll of $1 lives and resulted in damages in the millions of dollars. This second event had the effect of impressing the need for a comprehensive plan of remedial measures to ensure that such a disaster would never recur. The Metropolitan Toronto and Region Conservation Authority was established in 1957 and one of the first tasks undertaken by the Authority was the preparation of an overall Plan for Flood Control and Water Conservation. The flood control measures recommended in this Plan consisted of a series of dams and reservoirs to impound flood water, the improvement of stream channels at critical points to facilitate the operation of the dams and reservoirs, and the acquisition of certain tracts of vulnerable flood pain land. But flood control was not the sole purpose of the proposed remedial measures. Four other considerations are of vital importance: - regulation of summer flow as a pollution abatement measure; - use of reservoirs as artifical recreation lakes; - control of bank erosion; - provision of a ring of water supply sources around the Metropolitan Toronto area for emergency purposes; Remedial measures recommended include the following: 1, On the Humber River -- - 6 flood control reservoirs (3 of which would also be used to augment low summer flowoas a pollution abatement measure, and A -65 3 of which would be developed as recreational lakes); - related channel improvements at three key locations; - acquisition of 1,000 acres of flood plain land; 2. On the Etobicoke Creek -- - 1 dual - purpose dam and reservoir to serve as a recreational lake and as an auxiliary source of municipal water supply; - the acquisition of 1,200 acres of flood plain land; 3. On the Don River -- - four dual - purpose dams and reservoirs -- all of which would provide flood control and two of which would serve as recreational lakes; - channel improvements along a critical one -mile stretch of the river; - the acquisition of 2,000 acres of flood plain land; 4. On the Rouge River -- - the repair of a small dam which was badly damaged by the Hurricane Hazel flood; - the acquisition of a water conservation reservoir site above the dam; - the acquisition of 900 acres.of flood plain land; 5. On the Duffin Creek -- - two flood control and water conservation reservoirs; - the acquisition of 1,000 acres of flood plain land; 6. On the Highland Creek -- - one recreational reservoir; - the acquisition of $00 acres of flood plain land • 7. On Mimico Creek -- - the acquisition of 300 acres of flood plain land; $. The Black Creek Scheme is comprised of a small flood- retarding dam and reservoir and channel improvements along a 6 -mile stretch of the Creek. The purpose of the Scheme is to provide flood control, pollution control, and bank erosion control. The Plan was then submitted to the senior levels of government with signing of the respective Agreements taking place on June 14th, 1961, It should be noted here that under the provisions of the Plat, the Authority was seeking grants from the senior governments to the extent of 75% of the total cost of all the works. The Federal Government agreed to participate in the Plan for the large dams and reservoirs, and channel improvements, on condition that the Authority and the Province would complete all aspects of the Plan including small dams and reservoirs, and flood plain land acquisitions. When the Authority signed the Agreement with the Provincial Government on the basis of the reduced participation with the Federal Government, the Authority decided to implement the Plan on the basis of the Authority?s share being as outlined in the Plan for Flood Control, and approved by the municipalities. In accordance with the terms of the Agreement, the period over which the Plan could be financed could be extended over a longer period of time than the 10 -years proposed in the Plan. Exceptions to this practice have been made for specific projects such as the Claire - ville Dam and Reservoir, the Woodbridge Flood Control Channel, and sections A -69 7 of the Black Creek Channel. A summary of land acquisition to date is presented in Table I. It should be noted that while a total of $,324 acres had been acquired by the end of 1963, not all this land had been paid for. A number of the properties involved properties for which compensation has not yet been determined. It should also be borne in mind that considerable land for the Boyd Dam and Reservoir and the Arthur Percy Dam and Reservoir were acquired as Conservation Areas. The Authority had also acquired some flood plain lands under Water Control Schemes. Dillon & Company Under the provisions of the Agreement between the Authority and the Province, the Authority is required to submit a programme for the control and operation of the dams and reservoirs under routine and emergency conditions, and a programme for the establishment and maintenance of hydrometric and recording rain gauges in the region. As a result, the Authority retained the firm of James F. MacLaren Limited to prepare a preliminary report on Telemetering, Supervisory Control and Communications System for Flood Control Purposes. It is the opinion of the Staff that sufficient preliminary studies A -71 - 9 have now been carried out to enable the completion of the Plan, and this phase of our work is virtually complete. (d) Final Engineering: In order to call tenders for the construction of individual structures, additional engineering studies are required to enable the preparation of final drawings and tender specifications. Final design should be undertaken at as short a time as possible before bhe structure is to be built. (e) Construction: For several reasons, construction has not proceeded as rapidly as was envisioned in the initial project schedule. These reasons include the time lapse through preliminary engineering studies to final design and the necessity of acquiring lands as they become available. Construct- ion has now been completed for: Woodbridge Channel Improvements Black Creek Channel Improvements - Scarlett Road to Rockcliffe Black Creek Channel Improvements - Rustic Road to Wilson Claireville - Indian Line Road - Steeles Avenue Bridge - Flood Corrtrol Dam The Authority has recently awarded a contract for the Black Creek Channel Improvement from Rockcliffe Blvd. to Alliance Avenue. OTHER WORKS: The completion of some of the preliminary engineering reports referred to in an earlier section of this report has revealed the necessity of certain other flood control works in order to achieve the objectives of the Plan -- i.e. -- to provide a comprehensive programme of flood protection for the entire region and prevent the recurrence of a Hurricane Hazel -type disaster. (a) Etobicoke Creek: The preliminary study of the proposed Snelgrove Dam and Reservoir has revealed that this structure, being situated well upstream on the West branch of the Etobicoke, will afford only a limited control of flood flows in the downstream portion of the watershed. It would appear that at least one additional reservoir will be required for the Etobicoke Creek. In addition, extensive channel improvements will be necessary in the lower reaches of the Creek, particularly in the vicinity of Dundas Street. (b) Mimico Creek: The absence of any specific remedial measures for the Mimico Creek was explained in the 1959 Plan as follows: At present, reconnaissance surveys and estimates of proposed remedial measures have not been undertaken for the Mimico Creek. This should not be construed as an indication that no flood control problem exists on the Mimico Creek. On the contrary, the flood control and pollution problems are as critical on the Mimico as on the other watersheds of the area. In fact, the problems are aggravated by the fact that so much of the watershed has succumbed to dense urban development that zoning restrictions are too late. There are no suitable reservoir sites on the Mimico Creek, and the only feasible flood control works would consist of channel improvements. The Authority intends to in- vestigate the Mimico with regard to flood control measures at the earliest possible opportunity. However, in the absence of more complete survey data, it has been deemed best not to defer the presentation of this Brief until such surveys are completed. It is hoped that further consideration will be given to the problem of financial assistance for Mimico flood control measures in the future. Arising out of the preliminary engineering study for the Mimico Creek, the following works are now proposed: (i) Channel Improvements (ii) Channel Improvements (iii) Channel Improvements (iv) Channel Improvements (v) Channel Improvements - Queensway Avenue - 1,800 feet - Royal York Road - 4,400 feet - Dundas Street vicinity - Disco Road vicinity - Village of Malton - 3,900 feet This report also confirmed that there are not any potential storage sites for reservoirs in the Mimico Creek datershed that could be considered economically feasible. - 12 - A -74 (n) Duffin Creek: (i) Pickering - Riverside Area: The preliminary study of the Duffin Creek datershed has revealed that in addition to the reservoirs proposed on the two main branches of the Creek, major channel improvements will be required at the confluence of the East and West branches of the Duffin Creek in order to afford adequate flood protection for the lower Duffin Creek. (ii) Village of Stouffville: Although the fact was unknown to the Authority at the time of preparing the 1959 Plan, the Village of Stouffville has been plagued by intermittent flooding of rather serious proportions. The solution to the problem involves a combination of the acquisition by the Authority of un- developed flood plain lands, construction of a concrete -lined channel through the built portion of the Village, and the establishment of a multi - purpose dam and reservoir upstream of the Village to control flood flows and augment Summer flow. (d) Telemetering, Supervisory Control and Communications System: In accordance with the requirements of the Agreements with the senior levels of government, the Authority has obtained a preliminary study for the establishment of a Telemetering, Supervisory Control and Central Communications System for flood control purposes. The estimated cost of this system is $275,000.00. A -75 V. FINANCING: - 13 - The financing of the Plan for Flood Control and dater Conservation has been complicated by a number of factors. The decision of the Federal Government not to participate in the acquisition of flood plain lands and small dams and reservoirs, placed an additional burden on the Authority. The decision of the Authority not to increase the municipal levy to compensate for these additional costs resulted in a reduction of committed expenditures for the 10 -year period of $7,555,6$0.00 or almost 20%. The project schedule adopted by the Authority attempted to compensate for this reduction. The reductions were made as follows: SCHEDULE "A" "B P4 "C" TOTAL DIFFERENCE AGREEMENT $ 24,000,000. 2,600,000. 12,300,000. $ 3$,900,000. COMMITTED $ 19,955,000. 4,045,000. 2,600,000. 4,74$,000. $ 31,34$,000. $ 7,552,000. It will be noted that all the reductions were made in Schedule "D" -- Flood Plain Land Acquisition. The acquisition of flood plain and conservation lands has proceeded at a faster pace than was originally scheduled. The reasons for this are as follows: (i) The Authority has found it essential to acquire many of these lards at the time of subdivision. Municipalities have co- operated with the Authority in designating those lands proposed for acquisition in subdivision plans under consideration. It has been found by those municipalities and the Authority that it is essential to acquire these areas immediately in order to act in good faith with the developer, who - in most cases - agrees to conform to the policies of the Authority and the municipality. Due to unforeseen growth in this area, land is being subdivided much faster than anyone anticipated. The result is that the Authority is being called upon to purchase lands far beyond the limit of present capabilities. Municipalities and The Ontario Municipal Board are assuming the attitude that if zoning favourable _ to conservation concepts is placed upon valley lands, the private owner must be reimbursed by the Authority within a short space of time. (ii) The Authority designated certain key areas, such as Eglinton Flats on the Humber River, lower Don Valley and lower Highland Creek Valley, for early acquisition. This action was taken in order to co- ordinate with other municipal activities. It was felt that many economies could result from one - agency acquisitions. (iii) The basic policy of the Authority has been to acquire lands as they - 14 - A -76 come on the market. This basic policy has worked to the advantage of the Authority but has complicated the financial picture. A great many people, knowing that their lands are planned eventually for acquisition, approach the Authority for acquisition. Many factors contribute to this, such as mortgage renewals, settlements of estates, V.L.A. extension, relocation of people because of changes in employment, and a sincere desire on the part of some people to sell their property to the Authority to ensure its preservation. For the foregoing reasons, the Authority has expended considerably more than was scheduled for flood plain land acquisitions and has indeed committed all the funds available for flood plain lands for the entire schedule. It is of paramount importance that a solution be found to the flood plain and conservation land account which has been reduced because of a reduction in Federal Government participation and which has been expended or committed for the reasons set out beforehand. It is also evident that the total cost to complete the Plan is going to be considerably more than was originally estimated in the Plan. The factors that have contributed to the increased costs may be grouped under three main headings: (a) Lack of Sufficient Engineering Data; (b) Under - estimate of Land Costs in 195$; (c) Under - estimate of Total Acreage Requirements; (a) Lack of Sufficient Engineer) ng Data : At the time of preparation of the Plan, there was very little engineering data available from which to determine with very much accuracy the amount of storage actually required; the size of structures necessary for control; and specific site problems to be provided for; all of which directly influence the cost of the structures. Because of this lack of information, the Authority has obtained preliminary engineering studies for all the watersheds in the region. As a result of these studies, a number of changes have resulted which have affected the cost estimates: (i) Hydrology: As stated in the Plan, the Authority's policy with respect to the design of dam spillways is as follows: To safeguard downstream communities and human life, all dam spillways must be designed to prevent over - topping and destruction of the dams. All spillways will be designed to carry the maximum possible flow produced by the maximum possible rainfall. The following table shows the comparison of predicted maximum flows to be accommcdated at each damsite as contained in the Plan and as a result of the engineering studies. Based on the hydrology, certain changes i' the height of the dams, with a resultant increase in storage capacity, have had to be increased considerably. There were no detailed appraisals of property values available. Also, the Authority had only a limited experience in land acquisition on which to base cost estimates. Further, it was not possible to give consideration to severance damages for partial taking of properties as no detailed information pertaining to the ownership of properties required was available. (c) Under - estimate of Total Acreage Requirements: Perhaps even more significant than the under- estimate of per acre costs was the under- estimate of total acreage requirements. This again was the result of a lack of engineering information as to properties affected and a lack of information pertaining to property ownership. A comparison of acreage requirements as estimated in 1958 and as calculated from current data available can be seen in Table I. (d) Construction Costs: Construction costs have steadily risen in the Metropolitan Toronto area. The economy of the area for the past few years has been booming and a great deal of public and private - 16 - A -78 capital investments in construction has taken place. The result has been to reduce competitive bids and increase costs. The Province of Ontario recently announced a new policy of financing for small dams and reservoirs as set forth herewith: 1. Reservoir projects approved by the Government for grant purposes prior to January 1, 1967, can be totally financed by the Government. The local share of the project (25 %) will carry a three -year interest -free period. 2. The interest -free period will commence on the date of approval of the Government grant on the project. 3. A further ten -year period will be allowed for the repayment of the unpaid balance. 4. The unpaid balance will bear interest at a rate to be determined by the Government when the grant is approved. 5. At least 10% of the unpaid principal will fall due and be paid each year by the Conservation Authority. The Authority has already taken advantage of the new policy and has proceeded with the Milne Dam and Reservoir on the Rouge River at Markham. Other dams will be eligible for the assistance. A -79 - 17 - VI. RECOMMENDATIONS -- as amended by resolutions of Flood Control and Water•Oonaervation Advisory Board Meeting No. 3/64, held on November 5th, 1964, and by resolution of Executive Committee Meeting No. 20/64 held on November 12th, 1964: 1. The Authority request the Province of Ontario for a grant of 75% of the cost of the acquisition of Flood Plain Lands; 2. The Authority request the Province of Ontario to totally finance the acquisition of Flood Plain and Conservation Lands to the extent of funds provided in the Plan for Flood Control and Water Conservation, and to provide for an extended period of re- payment of the Authority's share on a basis similar to the Government policy for small dams and reservoirs as recently announced; 3. The Authority make application for the construction of the following Reservoirs under the new policy recently announced by the Government: (i) Duffin Creek -- Arthur Percy Dam & Reservoir Stouffville -- Water Conservation Reservoir (ii) Etobicoke -Creek -- Water Conservation Reservoir 4. The Province be requested to finance the Authority's part of the construction of the Finch Dam on the W,:st Branch of the Don River which is essential for the total development of the Province's Museum of Science and Technology; 5. The total Authority levy for Flood Control and Water Conservation be diverted to Schedule "A" -- Large Dams & Reservoirs -- and that the following works be scheduled for early construction: (i) York Mills Channel (ii) Bolton Dam & Reservoir (iii) Ebenezer Dam & Reservoir 6. (1) INTRODUCTION: The purpose of this Report is to consolidate in one Report the land acquisition policies and programmes that have been adopted by the Authority since its establishment. (2) HISTORY: The original recommendations for the acquisition of lands for conservation purposes were contained in the Conservation Reports prepared for the Etobicoke - Mimico, Humber, Don, and R.D.H.P. Authorities. (3) LAND ACQUISITION PROGRAMMES -- PREVIOUS AUTHORITIES: The four Authorities that existed in the Metropolitan region prior to 1957 had commenced a land acquisition programme for reforestation, conservation areas, and flood and water control purposes, and these programmes formed the nucleus for the develop- ment of programmes and policies of the Metropolitan Toronto and Region Conservation Authority. A total of 2,004 acres had been acquired prior to 1957. (4) LAND ACQUISITION PROGRAMMES & POLICIES M.T.R.C.A. - 1964: The legislation under which an Authority acquires land for conservation purposes is contained in Section 17 of The Conservation Authorities Act, R.S.O. 1960 Chapter 62. The procedures for expropriation are also outlined in the Act and are governed by The Expropriation Procedures Act. The Authority acquires the following four categories of land for its Conservation Programme: - Reforestation Lands - Forest & Wildlife Conservation Areas - Conservation Areas A -85 - Flood Control & Water Conservation Lands (1) Flood Plain & Conservation Lands (2) Lands Required for Channel Improvements (3) Reservoir Lands The Authority has acq "fired 1,733 acres of Reforestation land and 844 acres of Forest & Wildlife Conservation Area lands. The Plan for Ancillary Conservation Measures adopted by the Authority in 1962 and submitted as a requirement of the Flood Control Agreement, proposes the acquisition of a total of 4,500 acres of reforestation lands and 5,000 acres of Forest & Wildlife Conservation Area lands by the year 1980. The Authority has acquired 4,934 acres of Conservation Areas land. In 1959 the Authority adopted a 3 -year programme to complete and consolidate existing Conservation Areas and acquire one additional area. The Programme has been extended over additional years because of a diversion of funds to the Plan for Flood Control and Water Conservation. One new Conservation Area is under consideration. A total of 650 acres will complete the 1959 Plan and acquire the St. Georges Lake Conservation Area A small acreage of land had been acquired for Flood Control purposes prior to 1957. The Metropolitan Toronto and Region Conservation Authority prior to 1961 had acquired 1,176 acres of Flood Plain and Conserv.on lands and 1,633 acres of Reservoir lands. The acquisition of lands for Flood Control & Water Conservation purposes is accomplished under the Plan for Flood Control and Water Conservation and is undertaken in accordance with procedures adopted by the Authority and the Province of Ontario. A Master Plan for Flood Plain and Conservation Lands was adopted by the Authority in 1962. Preliminary property plans have been approved for Channel Improvements and Flood Control Reservoirs. The Authority has approved acquisition of 19,048 acres of lands for Flood Control purposes of which 8,324 have been acquired to date. A -$6 (5) FINANCES: Small amounts of money are annually budgeted for the acquisition of Reforestation lands and Forest & Wildlife Conservation Areas, and these are acquired when they are available on the market. A decreasing amount of funds have been devoted to Conservation Areas Land Acquisition as a result of a diversion of funds to the Flood Control Plan. A Conservation Areas Land Acquisition Programme adopted in 1959 has not yct been completed as a result. A substantial portion of the annual Authority Budget is devoted to Flood Control and Water Conservation and in the early years of the Plan, a large part of this has been devoted to land acquisition. Of a total of 6$,720 acres of lands suitable for Conservation purposes, the Authority has presently acquired 15,$35 acres and until 19$0 has proposed a total acquisition of 34,209 acres, or approximately one -half of the recommended total. (6) OTHER METHODS: Co- ordination of the Authority?s Land Acquisition Programme and Policies is effected by liaison with Metropolitan Toronto and its Planning Board and the area Councils and Planning Boards. It was suggested that this acreage would have a total maximum capacity of 14,000 people for recreation. The Albion Hills Conservation Area, consisting of 756 acres of land, was visited by 12,000 people on Sunday, June 28th, 1964. The Humber Authority had acquired lards in all three categories -- Reforestation Multiple - purpose Conservation Areas - and. for Flood Control Purposes The Etobicoke - Mimico Authority had acquired one Multiple - purpose Conservation Area, and lands for two Flood Control projects. The Don Authority had acquired one small community Conservation and Wildlife Area near Thornhill. The R.D.H.P. had purchased one Reforestation block and had initiated a programme for the acquisition of Flood Plain lands in the lower Highland Creek. The Land Acquisition Programmes of the previous Authorities formed the nucleus for the development of programmes and policies of the Metropolitan Toronto and Region Conservation Authority in 1957. The Programme evolved and expanded to meet the conservation needs of the rapidly expanding Metropolitan Toronto. - 4 - (4) LAND ACQUISITION PROGRAMME & POLICIES M.T.R.C.A. - 1964: A -92 (a) Legislation: The legislation under which an Authority acquires land for servation purposes is contained in Section 17 of The Conserv- ation Authorities Act, R.S.O. 1960, Chapter 62; as follows: "(c) to acquire by purchase, lease or otherwise ad without the consent of the owner to enter upon, take or expropriate any land that it nay require and, subject to the approval of the Lieutenant - Governor in Council, to sell, lease or otherwise dispose of land acquired under tho clause or under clause i; (d) to purchase or acquire any personal property that it may require and sell or otherwise deal therewith; (f) to enter into agreements with owners of private lands to facilitate the due carrying out of any scheme or conservation project; (h) to use lands that are owned or controlled by the Authority for such purposes, not inconsistent with its objects, as it deems proper; to acquire lands, with the approval of the Minister, and to use lands acquired in connection with a scheme, for park or other recreational purposes, and to erect, or permit to be erected, buildings, booths and facilities for such purposes and to make charges for admission thereto and the use thereof; to collaborate with departments and agencies of government, municipal councils and local boards and other organizations;" The procedures to be followed in expropriation of land are contained in Sections 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, and 36, and are governed by The Expropriations Procedures Act, (i) (3) The Metropolitan Toronto and Region Conservation Authority acquires the following four categories of land for its Conservation Programme; Reforestation Lands: These lands are situated in the headwater areas of the watersheds and consist of lands which are sub - marginal for agricultural production. The lands are such that they provide limited opportunity for recreational development. The lands are under Agreement with the Department of Lands and Forgsts whereby their develop- ment, operation, and management is the responsibility of the Department until the yeg.r 2000. Forest & Wildlife Conservation Areas: These lands are situated in the headwater are sub - marginal in character and are not Reforestation Lands except that they have potentials for the development of outdoor facilities. The primary purpose of these regions and unlike greater recreational lands is reforestation. A -93 5 However, additional physical character of the lands makes them suitable tc develop limited outdoor recreation facilities such as hiking, nature study, and fishing. Conservation Areas Land: Conservation Areas are lands which -- because of their nature -- require a variety of conservation treatments and, in addition, provide an opportunity for the development of a large variety of outdoor recreation facilities which are attractive to a large segment of the regional population. Flood Control & Water Conservation Land: Three types of land are required in connection with the Flood Control and Water Conservation Plan of the Authority: (1) Flood Plain & Conservation Lands -- lower sections of the main river valley systems consisting of the low -lying lands subject to periodic inundation, to- gether with steep valley slopes subject to erosion; (2) Lands Required for Channel Improvements -- lands required for the construction amd maintenance of major Channel Improvements; (3) Reservoir Lands -- areas required for the construction of Dams and Reservoirs, and for the development of recreational facilities where recreation lakes are created; (b) Reforestation Lands: Reforestation Lands are acquired when they are available on the market. Each year a small amount of money is budgeted for the acquisition of these lands. Lands acquired for Reforestation purposes are placed under Agreement with the Minister of Lands and Forests for mannage- ment. Approval by the Minister of Lands and Forests is required prior to the acquisition of these lands. The Province of Ontario pays a grant of 50% of the cost of Reforestation Lands, together with a grant of 100% of the appraised value of existing woodlots. The Programme for the acquistion of Reforestation Lands is contained in The Plan for Ancillary Conservation Measures adopted by the Authority at Meeting No. 2 held on Wednesday, February 21st, 1962, and submitted to the Minister of Lands and Forests for approval in fulfillment of Section 20 of the Agreement A -94 6 between the Government of Ontario and the Metropolitan Toronto and Region Conservation Authority for the implementation of the Plan for Flood Control and Water Conservation. The Plan was approved by the Minister in April, 1962. These are lands the t are to be used primarily for Reforestation purposes but, because of their physical nature, can provide limited opportunities for low- intensity recreation use. These lands are acquired when they are available on the market. Each year approximately $30,000.00 is budgeted for the acquisition of Forest and Wildlife Conservation Areas. They are developed and managed by the Authority. Each parcel of land acquired is submitted to the Minister of Energy and Resources Management for approval as a Scheme. The Authority adopted a Forest and Wildlife Conservation Areas Survey at Meeting No. 4 held on October 26th, 1962, setting forth the policies with respect to the type of land. The programme for the acquisition is contained in the Plan for Ancillary Conservation Measures, adopted by the Authority at Meeting No. 2, held on February 21st, 1962, and was submitted to the Minister of Lands and Forests for approval in fulfillment of Section 20 of the Agreement between the Government of Ontario and the Metropolitan Toronto and Region Conservation Authority A -95 -7 for the implementation of the Plan for Flood Control and Water Conservation. The Plan was approved by the Minister in April, 1962. (c) Conservation Areas Land: The Etobicoke - Mimico and Humber Valley Authorities had made considerable progress in a Conservation Areas Land Acquisition Programme prior to the formation of the Metropolitan Toronto and Region Conservation Authority in 1957. One of the first efforts of the newly formed Authority was to round out a Programme of Conservation Areas Land Acquisition in the region over which it had jurisdiction. This necessitated the acquisition of lands in the central and eastern sections of the region. The Greenwood, Claremont, Glen Major, and Bruce's Mill Conservation Areas are the results of this Programme. A Conservation Areas Land Acquisition Programme for d - O the period 1960 -1961 -1962 was adopted at Meeting No. 5 of the Authority,held on December 10th, 1959. The Authority budget for Conservation Areas Land Acquisition in 1964 is $120,000.00. These funds are being used for the acquisition of properties, adjoining existing Conservation Areas, as they become available on the market. In certain instances where key properties are threatened with development, the Authority files Plans of Expropriation on these lands. At the present time, one new Conservation Area has been approved for acquisition by the Authority. The Staff has been able to negotiate an Agreement for the purchase of the St. George's Lake Conservation Area over a period of five years. The proposal will have to be adopted by the Authority and submitted to the Province for approval. The 1960- 1961 -1962 Conservation Areas Land Acquisition Programme recommended a programme of enlarging and consolidating existing Conservation Areas, together with the establishment of one new Conservation Area. The new Area proposed at tat time was the Bond Lake Conservation Area. This proposed scheme has never materialized due to high cost of land. The Bruce's Mill Conservation Area was not included in the programme and could thus be considered as an alternative to the Bond Lake Area. The Programme adopted in 1959 has not been entirely completed and has had to be extended over additional years as a result of the diversion of Conservation Areas Land Acquisition funds to the Flood Control and Water Conservation Plan during the years 1963 and 1964. The R.D.H.P. had initiated a scheme for the acquisition of Flood Plain Lands in the lower Highland Creek, but had not actually acquired any properties. The Metropolitan Toronto and Region Conservation Authority initiated the first stages of a comprehensive Flood Control Programme aaon after its establishment and involved the acquisition of Flood Plain Lands in the lower Humber and lower Highland Creek. Channel Improvements were commenced on the Black Creek, and a Pumping Station was constructed at Goodwood. The Executive, at a meeting on May 10th, 1961, adopted a Statement of Policy on Flood Plain and Conservation Lands. This Statement was published and circulated to the member municipal- ities and planning boards. The policy with respect to the acquisit- ion of Flood Plain and Conservation Lands as stated in this report, is set forth herewith: The policy of the Metropolitan Toronto and Region Conserv- ation Authority is to quire the Flood Plain and Conservation Lands in the downstream sections of the main valley systems under the jurisdiction of the Authority. The Authority is of the opinion that for adequate control of these lands for Flood Control and Conservation purposes, it is essential that they be owned by a public agency such as the Authority. The ownership of these lands, therefore, ensures their proper use in order that the objectives of the Authority can be achieved. The Flood Plain and Concervation Lands in public ownership can be used for other than Flood Control and Conservation purposes for they provide an oppor _unity for the provision of public open space and recreation facilities that are an essential feature of every urban d--•Alopment.. The Authority has ac, ired major acreages of Flood Plain and Conservation Lands in the main valleys within Metropolitan Toronto, and proposes the extension of this Plan to cover the lower reaches of all the major watercourses under the jurisdiction of the Authority. These lands have been acquired under what is known as Water Control Schemes. The Schemes set forth the lands to be acquired; the estimated cost of the acquisition; the purpose for which the lands were to be used; and the scheduling of acquisition. The majority of Water Control Schemes adopted to date have been in the Munie4pallty of Metropolitan Toronto, and this municipaity has been designated as the benefitting municipal- ity and required to pay 50% of the cost of the acquisition of Flood Plain Lands The Province of Ontario contributes the remaining 50% of the cost. Under the provisions of the Agreemententered into on June 14th, 1961, between the Authority and the Prcvince of Ontario, the Authority will acquire an additional 7,600 acres of Flood Plain Land over the next ten years. The cost of this land will be - 10 - A -98 shared equally between the Authority and the Province. In addition to the acquisition of Food Plain and Conservation Lands, the Authority is responsible for the undertaking of Conservation measures required for the control of stream bank erosion and for the development of watercourses for Flood Control purposes. Some Water Control Schemes include these works as part of the Scheme, whereas others are undertaken as additional Schemes after the lands have been acquired and development for recreation purposes has been completed. In many instances, municipally -owned lands are included in Water Control Schemes. The policy of the Authority and the Province of Ontario is that where municipally - owned lands are within a Scheme, they must be transferred to the Authority for a nominal sum. The Province of Ontario will not pay grants for municipally -owned lands included in Water Control Schemes. Most of the municipalities within Metropolitan Toronto and, in severl instances, , outside Metro, have co- operated with the Authority in the transfer of these lands to the Authority. The Authority assumes all survey and legal costs involved in the transfer of municipally -owned lands. The acquisition of lands for Flood Control and Water Conservation purposes continued on this basis until the signing of an Agreement with the Province of Ontario on June 14th, 1961, for the PLin for Flood Control and Water Conservation. The procedures to be folio ^fed for the implementation of the Plan were adopted at Meeting No. 5 of the Authority held on November 23rd, 1961. Pertinent sections of this report are summarized as follows: Flood Plain Land Acquisitions: 1. Staff to prepare Master Plan (in progress); 2. Master Plan to be reviewed by Staff Committee; then to the following for approval: (a) Flccd & Pollution Control Advisory Board b) Executive Committee c) Authority d) Province 3. For individual properties, Staff to prepare detailed Plan showing relationship to Master Plan; 4. This is to be submitted to: (a) Executive Committee (b) Province 5. When approved by Province, Property Section to proceed with acquisition; Small Dams: Procedure the same as previous procedure for individual projects under Flood Control Plan, only difference being that Federal Government approval is not required. A-99 The Province of Ontario set forth on November 8th, 1961, the Procedure for acquiring land in accordance with Agreements as set forth herewith: PROCEDURE FOR ACQUIRING LAND IN ACCORDANCE WITH THE AGREEMENTS BETWEEN ONTARIO AND THE CONSERVATION AUTHORITIES FOR THE CONSTRUCTION OF DAMS, RESERVOIRS, CHANNEL IMPROVEMENTS AND FLOOD PLAIN LANDS Section 16(1) states: "The Authority agrees that no Flood Plain Lands or lands required for the ecmpletion of the Dams, Reservoirs and Channel Improvements included in this Agreement shall be acquired without the prior approval of the Provincial Minister or his representatives." 1. For Approval in Principle (1)(a) The Authority prepares a topographic plan of appropriate scale on which are indicated the areas required for the projects. The area boundaries would be approximate and would clearly indicate the relation- ship of the properties involved to the limits of the project, the river, its valley and flood plain. (b) For Reservoirs the plan would indicate the approximate limits of the lands to be flooded under maximum probable flood conditions. (c) For Seother works" such as construction areas, access ereas, etc., the limits of the land required for these purposes must be clearly indicated and covered by explanatory notes on the plan. (2) The Authority submits this plan to the Conservation Branch for approval (two copies for Ontario- Authority projects, and three for Canada - Ontario- Authority projects). (3) If in order, one copy of the plan stamped V4Approved" and signed by the Minister, or his represent- ative, will be returned to the Authority. 2. For Final Approval (1) Having received approval of the plan in principle, the Authority obtains a report from an approved land appraiser and, where necessary, a land survey of the property or properties required. If there are any significant changes in the property boundaries as shown on the plan submitted in gccordance with Section 1(2) above, the Conservation ranch must be notified by letter stating the reasons for the change and requesting approval for these lands outside of the original property boundaries. (2) The Authority submits a final land survey plan and a land appraiser's report to the Conservation Branch (2 copies of each for Ontario- Authority projects, and 3 copies of each for Canada- Ontario- Authority projects). (3) If the approved land appraiser's report and land land survey plan of the property or properties to be acquired are in order, the Conservation Branch A -100 - 12 will issue a Certificate of Inspection in quadruplicate, one copy of which will be forwarded to the Authority. This certificate is a statement of approval to acquire the land under Agreement; (,! If it is necessary to expropriate the land or lands the Authority proceeds in accordance with the Conservation Authorities Act. November $, 1961 At Meeting No. 3 of the Authority, held oft April 28th, 1960, the Authority adopted a policy for Reservoir Planning with the following recommendations being adopted: 1. That no private ownership or leanes be permitted adjacent to the Reservoir proper; 2. That the use of the water supply in the Reservoir for domestic or agricultural purposes by private individuals be permitted only with the consent of the Authority; 3. That with..the consent of the Authority, the right -of- easement be granted to a municipality when required, but that no private easements be permitted; 4. That a buffer strip consisting of not less than one hundred feet from the high water level be established around the Reservoirs: 5. That the Plan of Development for the non - recreational Reservoirs include provision for reforestation of the buffer zones, and that the Plans of Development for the recreational Reservoirs include reforestation for the buffer zones not to be used for recreation; (i) Flood Plain Lands: The Authority adopted a Master Plan for Flood Plain and Conservation Lands at Meeting No. 1 held on February 9th, 1962. The Plan was submitted to the Province of Ontario for approval in principle, and thus has been the basis for Authority Flood Plain Land Acquisition. The following is a summary of the pertinent sections of this report: All land falling within the definition of Flood Plain and Conservation Lands has been mapped and classified in one of the following classifications based on the ownership: (a) Authority -Owned Lands -- lands already acquired by the Authority in connection with the Water Control Schemes; (b) Public Lands -- all publicly -owned lands other than those already acquired by the Authority -- this includes lands owned by municipalities and departments or agencies of the Province of Ontario and the Government of Canada. (c) Semi - Private Lands -- all lands held by private corporations such as hospitals and golf courses, which are available for open space type of use by some segment A -101 - 13 - of the general public. Under their present use, these 'lands are not proposed for acquisition. (d) Private Lands -- all lands under private ownership which are proposed for acquisition for Flood Control and Conservation purposes. The plans are submitted to the Executive and to the Province for approval. The basic policy of the Authority with respect to property acquisition for Channel Improvements is that the Authority acquire those lands required for the actual construction of the Improvements, together with sufficient additional land for the maintenance and eventual replacement of improvements. The plans are submitted to the Executive and the Province for approval. The policy for Reservoir Planning, adopted by the Authority at Meeting No. 3 held on April 28th, 1960, is the guide for the preparation of these plans. The Authority acquires lands within these Reservoir areas as they become available on the market and, in the case where construction of the Dams is to be proceeded with, Plans of Expropriation are filed for all of the lands required for the project. In Reservoirs where negotiations have failed, and there is a possibility of lands being lost for the Reservoirs, the Authority files Plans of Expropriation. A -105 - 17 - The Iand Acquisition Programme was reduced considerably in 1963 and 1964 as a result of the diversion of funds from Conservation Areas Land Acquisition to the Flood Control Programme. The results of this are that the 1960 -1961 -1962 Conservation Areas Land Acquisition Programme adopted by the Authority has not been entirely completed. The Province of Ontario pays a grant of 50% of the cost of Conservation Areas Land. (d) Flood Control & Water Conservation: The financing of the acquisition of lands for Flood Control purposes has been divided into two periods since the Authority was established in 1957. Prior to June 14th, 1961, when the Authority signed an Agreement with the Province of Ontario, lands for Flood Control purposes were acquired on the basis of Water Control Schemes with the Province of Ontario paying 50% of the cost, and the Authority paying the remaining 50%. In many of these Schemes involving lands within the boundaries of the Municipality of Metropolitan Toronto, Metro was designated the benefitting municipality and paid 50% of the land acquisition costs. Since the signing of the Agreement on June 14th, 1961, a more complicated arrangement has resulted in the acquisition of lands for Flood Control purposes. This, at the present time, is the Authority's Land Acquisition Programme for the next 20 -year period. A -107 - 19 - (6) OTHER METHODS: The Authority's Land Acquisition Programme and Policies are facilitated by co- operation with the municipalities in processing of plans of sub - divisions, zoning by -laws, and official plans. The Draft Metropolitan Toronto Official Plan has incorporated the Authority's Land Acquisition Programme and Policies. The Authority has been able, in co- operation with the municipalities, to effect economies in its main acquisition programme as a result of co- ordination and co- operation with municipalities; instead of a number of agencies acquiring lands for various purposes such as sewer easements, road widenings, etc., the Authority acquires the land and then transfers the required portion to the proper agency. B E T W E E N: THE METROPOLITAN TORONTO and REGION CONSERVATION AUTHORITY hereinafter called "The Authority ", OF THE FIRST PART. -and - THE MUNICIPALITY OF METROPOLITAN TORONTO hereinafter called "Metro ", OF THE SECOND PART. WHEREAS the Authority has been and is acquiring flood plain and conservation lands in Metropolitan Toronto. AND WHEREAS Metro is desirous of using these lands so acquired for park and recreational purposes. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the recitals herein and the carrying out of the various obligations contained in this Agreement the parties hereto agree as follows: 1. 2. The Authority shall proceed to acquire all the lands as included in the Master Plan appended hereto as Schedule "A" for Flood Plain and Conservation Lands, and as amended from time to time, within the boundaries of Metropolitan Toronto as quickly as may be practical,• the title of the said lands to be taken in the name of the Authority. Upon the acquisition of the lands aforesaid, the Authority shall notify Metro of the date on which the said lands can be turned over to Metro with vacant possession, or as otherwise arrang6d, and Metro shall accept delivery and possession of the said lands on that date. The Authority shall provide Metro with A -109 - 21 - a plan of survey and legal description of the said lands. Said lands shall forthwith, from the date of notification, be deemed to be park lands. 3. Metro will develop and maintain these lands for park, recreational and conservation purposes with the necessary administration and supervisory accommodation in connection therewith and for no other purpose except with the approval in writing of the Authority. 4. The cost of development and maintenance of these lands shall be borne by Metro and all plans for such develop- ment shall be submitted to the Authority for its approval in writing. Metro shall assume the full cost and respons- ibility for the maintenance of said park lands, and other lands both inside and outside Metro as may be agreed upon from time to time, provided, however, that if the Authority is of the opinion that Metro is not properly maintaining such lands, then the Authority may, on notice to Metro, enter upon the said lands for the purpose of maintaining them and any costs incurred by the Authority by reason of so doing shall be paid to the Authority by Metro forthwith upon the demand thereof. 5. No permanent buildings shall be erected on these lands without first obtaining the consent in writing of this Authority, both as to location and type of building. 6. The Authority shall retain control of all aspects of the river channels, flood control, river protection, erosion control and dams and Metro shall not interfere with the carrying out of such works as are necessary for these projects. 7. Metro shall not alter the course of any river, brook, stream or watercourse without first obtaining the consent and approval in writing of the Authority. $. Metro shall not have the right to lease or otherwis., dispose of the said lands herein, or permit concessionaires 9. 10. 11. A -110 - 22 - thereon without prior approval of the Authority, the said approval to be given in writing. Metro shall pay all taxes or other charges levied against the said lands, including lands under water, and shall assume the paid tax liability on and after the first day of January following its acceptance of the said lands. Metro deems that the lands included in Schedule 'A" of the Master Plan for Flood Plain and Conservation Lands within the boundaries of Metropolitan Toronto have a Metropolitan Park potential and that the Metro- politan Parks Commissioner may accept delivery of possession of the said lands under the terms of this agreement. Metro covenants and agrees to indemnify and save harmless the Authority of and from any and all manner of claims, damages, loss, costs or charges whatsoever occasioned to or suffered by or imposed upon the Authority or its property, either directly or indirectly, in respect of any matter or thing in consequence of or in connection with or arising out of Metro's use, occupancy or development of the lands herein or out of any operation connected therewith or in respect of any accident, damage or injury to any peroon, animal or thing by, from or on account of the same. Metro covenants that the indemnity herein contained shall extend to all damages and claims for damages by reason of improper or faulty erection or construction of structures hereafter erected or installed on the said park lands or in connection therewith by Metro, its servants or agents and by reason of any insufficiency in such structure and whether or nct same have been approved by the Authority, its ,ervants or agents. It is understood and agrel that the Authority's name shall be suitably displayed on signs to be erected in A -111 - 23 - areas where the Authority has contributed to the land assembly programme, and the said name shall be displayed in such manner and size as agreed upon between the Authority and the Commissioner of Parks for Metro. 13. It is understood and agreed that possession of the lands referred to herein shall not be returned to the Authority except by mutual agreement by both parties hereto but failing such agreement any such request shall be referred to the Minister of Lands and Forests of Ontario for arbitration and his decision shall be final and binding on both parties hereto. 14. This agreement shall remain in full force and effect until superseded by an agreement mutually acceptable to the parties hereto but failing such mutual agreement the proposed changes shall be submitted to the. Minister of Lands and Forests of Ontario for arbitration and his decision shall be final and binding on both parties hereto. Hereinafter called "the Minister", OF THE SECOND PART. WHEREAS the Authority has resolved to acquire the lands described in Schedule "A" herto (hereinafter referred to as "the lands") for ttie purposes of a scheme as defined in The Conservation Authorities Act and the Minister has approved of such acquisition; AND WHEREAS the Authority has requested a Provincial grant towards the cost of acquiring the lands and the Minister has indicated that he is prepared to recommend to the Lieutenant - Governor in Council that a grant for the purchase price of the lands be made, subject to such price being in the opinion of the Minister a fair and reasonable price for the lands; NOW THEREFORE the Authority covenants and agrees with the Minister that if a grant for the cost of acquiring the lands is made to the Authority, it, the Authority, in consideration of the making of such grant will comply with the following conditions: 1. The Authority will engage the services of a duly qualified solicitor to take title to the lands in the name of the Authority in fee simple; the Authority will require of the solicitor that he certify that a good and marketable title in the lands has been acquired by the Authority-free-and clear of all encumbrances. In the event that the solicitor advises the Authority of an existing encumbrance or other flaw in the title the Authority will consult with the Minister prior to instructing the solicitor to accept such title. The Authority will use the lands for conservation purposes as defined in The Conservation Authorities Act R.S.O. 1950, c.62, s.15, and in no event will the lands or any part or parts thereof or any buildings or other structures thereon be sold, leased or otherwise disposed of without the approval in writing of the Minister. 3. No timber, logs, gravel, stone, minerals, top soil or material of any kind or nature shall be cut, removed, sold or otherwise disposed of from the lands without the approval in writing of the Minister or of the Director of the Conservation Branch of the Department of Planning and Development or his or their successors. SPOONER, Minister of Lands and Forests for the Province of Ontario, hereinafter referred to as the "Minister ", OF THE FIRST PART: - and - THE METROPOLITAN TORONTO AND REGION c_ONSERVATION AUTHORITY. hereinafter referred to as the "Corporation" OF THE SECOND PART. WHEREAS His Majesty the King in right of the Province of Ontario, as represented by the Minister of Lands and Forests, and the Humber Valley Conservation Authority entered into an agreement dated the 11th day of April, 1951, for '-he reforestation under the management of the Minister of land acquired by the Authority for reforestation; AND WHEREAS by an Act to Amend the Conservation Authorities Act, Statr es of Ontario 1956, Chapter 9, the Humber Valley Conservation Authority was dissolved and all the assets and liabilities of that Authority vrere vested in and became the assets and liabilities of The Metropolitan Toronto and Region Conservation Authority; AND WHEREAS to provide for a more comprehensive management of lands suitable for forestry purposes that are managed under agreements with the Minister, Section 2 of The Forestry Act, 1952 was amended by The Forestry Amendment Act, 1960 to define ( "forestry purposes" as meaning primarily the production of wood and wood products and including such secondary purposes as proper environmental conditions for wildlife, protection against floods and erosion, recreation, and protection and production of water supplies; AND WHEREAS the said section was at the same time further amended to authorize the Minister to make grants out of the moneys A -115 -27- appropriated therefor by the Legislature to any conservation authority or to any municipality for the purpose of assisting it in the acquisition of lands that are suitable for forestry purposes and that are to be managed under an agreement entered into under the said section of such sums as are provided for in the agreement; AND WHEREAS the Corporation wishes to enter into an agreement with the Minister under the provisions of thes;tid section; NOW THEREFORE THIS AGREEMENT WITNESSETH that in consider- ation of the mutual agreements andundertakings herein the parties hereto covenant and agree with each other as follows: 1. The Corporation doth hereby demise and lease unto the Minister the lands described in Schedule "A" hereto for the term of forty years from the 1st day of April, 1960. 2. The lands described in Schedule "A" hereto are hereinafter referrred to as the "Forest Area". 3. The Minister shall manage the Forest Area for forestry purposes and shall furnish such equipment, plant such trees, erect and maintain such fences, structures, buildings and improvements and do such other work that may in his opinion be required in connection with the management of the Forest Area, and the cost thereof shall be borne by Her Majest the Queen in right of Ontario. 4. The Minister will nct make any charge for the nursery stock furnished for planting on the Forest Area. 5. The Minister during the term of this agreement or any renewal thereof, may sell, lease or otherwise dispose of the trees or products therefrom, structures, buildings or improvements now or hereafter growing or erected on the Forest Area, and shall be entitled to the revenues derived therefrom provided that should the total revenuez_deriued -from the Forest Area exceed the total cost incurred by the Minister under this or any previous agreement between the parties hereto, the provisions of this paragraph may be reviewed on the request of either the Corporation or the Minister. - 28 - A -116 6. (1) In this paragraph (a) feland value's means the purchase price paid by the Corporation for land less the "timber values, and (b) ' ?timber value" means the part of the_purchase price paid by the Corporation for the wand that the Minister determines to have been paid for the timber on the land. (2) Where the Corporation, with the approval of the Minister in writing acquires any additional land for the purpose of this agreement and files with the Minister proof of ownership satisfactory to the Minister and a lease in triplicate of the land substantially in accord with Schedule "Bvv attached hereto, (a) Schedule "Ape to this agreement shall be deemed to be amended to include the land so acquired; and (b) the Minister shall, out of the moneys appropriated therefor by the Legislature, make a grant to the Corporation, for the purpose of assisting it with the acquisition of the land, in the amount of the timber value, 50% of the land value and 50% of reasonable solicitors fees and disbursements paid by the Corporation to secure title to the land in its name. 7. The Corporation shall during the last twelve (12) months of the term of this agreement select one of the four options hereinbelow set forth to take effect upon the expiry of the term of this agreement. OPTION 1: The Corporation shall pay to the Treasurer of Ontario the amount of the costs incurred during the term of this or any previous agreement by Her Majesty the Queen in right of Ontario in connection with the management of the Fcrest Area, but not including interest on such costs after deducting therefrom the amount of the revenues derived from the Forest Area, but not in- cluding interest on such revenue. OPTION 2: The Corporation shall pay to the Treasurer of Ontario fifty per cent of the amount that would be payable to the Treasurer of Ontario in the event Option 1 were exercised and shall enter into an agreement with the Minister providing for A -117 -29-- the management of the Forest Area for forestry purposes for such period, not less than 20 years, and subject to such terms and conditions as the Minister and the Corporation may agree upon, and without limiting the generality thereof, such agreement shall provide that the Minister shall have the sole and exclusive control and management of the lands in the Forest Area, and that the Corporation shall share equally with the Minister the cost of management of the Forest Araa including the cost of cutting, selling or otherwise disposing of the timber and other products on the Forest Area and the proceeds from the sale or other disposition of timber or other products from the Forest Area. OPTION; The Corporation shall grant the lands in the Forest Area to Her Majesty the Queen in right of Ontario as represented by the Minister of Lands and Forests, in fee simple, free from encumbrances, and shall execute a conveyance for the lands in the Forest Area upon payment by Her Majesty the Queen in right of Ontario to the Corporation of the purchase price paid by the Corporation for the Forest Area at the time of acquisition thereof by the Corporation. OPTION 4: The Corporation may renew this agreement upon such terms and conditions as are mutually agreed upon by the Corporation and the Minister. $. This agreement and any lease of lands filed with the Minister by the Corporation pursuant to subparagraph 2 of paragraph 6 shall be registered in the proper registry or land titles office in accordance with The Forestry Act. 9. The Corporation shall not, without the approval of the Lieutenant Governor in Council, use any lands in respect of which grants have been made under this agreement for any purpose that is inconsistent with forestry purposes at any time during the life of this agreement or at any time thereafter, and the Corporation, unless the order of approval of the Lieutenant Governor in Council otherwise provides, shall repay tre Minister all grants to it under - 30 - A -11$ this agreement in respect of lands that are used for a purpose that is inconsistent with forestry purposes. 10. Lands in respect of which grants have been made under this agreement shall not, without the approval of the Lieutenant Governor in Council, be sold, leased or otherwise disposed of during the life of this agreement or at any tine thereafter, and the proceeds from any sale, lease or other disposition of any such lands shall be shared equally by the Corporation and the Minister. 11. Paragraph 10 does not apply to a sale, lease or other disposition for the uses of Ontario. 12. In case of disagreement as to the true intent and meaning of this agreement, the same shall be referred for arb- itration under The Arbitration Act. 13. The parties hereto further covenant and agree that the agreement made the 7th day of April, 1951 between His Majesty the King in right of the Province of Ontario and the Humber Valley Conservation Authority is terminated and replaced by this agreement as of the 31st day of March, 1960.
