REPORT ON RECREATION & POLLUTION ABATEMENT IN THE TORONTO REGION
A report on Recreation and Pollution Abatement in the Toronto Region
was presented by the staff, and studied in detail.

RESOLVED THAT: The Report on Recreation & Pollution Abatement in the
Toronto Region, dated February, 1963, be received and,
THE BOARD RECOMMENDS THAT: The Report on Recreation and Pollution
Abatement in the Toronto Region, and the recommendations contained
therein as amended and set forth herein be adopted.
RECOMMENDATIONS:
THAT The Metropolitan Toronto and Region Conservation Authority -
1. Protect the recreation resources of the Region, not only under the
terms of the Ontario Water Resources Commission Act but also on the
basjs of riparian rights;
2. Assist the Ontario Water Resources Commission in its task of super-
vising sewage treatment programs for municipalities and of reconciling
all demands for water uses in the Region through the adoption of the re-
creation- pollution abatement plan for the Region as proposed in the
staff report Recreation and Pollution Abatement in the Toronto Region,
February, 1963;

3. Recommend to the Ontario Water Resources Commission, Department
of Municipal Affairs, the Metropolitan Toronto Planning Board and
other Planning,Boards in the Region, that they consider this plan in
formulating their policies on pollution abatement in the Region;
4. Request the Ontario Water Resources Commission to continue and
intensify its research activities in the field of tertiary treatment
of sewage including:
(a) treatment of effluent in oxidation ponds
(b) removal of suspended solids by sand filters
(c) removal of dissolved salts such as nitrates and phosphates
(d) removal of detergent materials such as A.B.S.
5. Where pollution from storm sewer discharges or storm overflows
from combined systems occurs at upstream points, encourage treatment
of these flows as far as economically reasonable;
6. Encourage conservation of sewage treatment plant residue from
municipal and O.W.R.C. plants such as all forms of sludge to be used
where appropriate as organic humus on farms and conservation areas as
well as sub - marginal areas which can be reclaimed for reforestation,
farming, etc.
7. Request the Province of Ontario to investigate any problems in
pollution abatement posed by the general use of detergents, that is
to investigate detergents as they may interfere with sewage treatment
processes, excessively enrich receiving waters or indirectly create
hazards to public health, and to take appropriate action to solve
problems which may be revealed;
$. Co- operate with upstream municipalities in facilitating tertiary
treatment and disposal of sewage from present development, where such
treatment is vital to the Authority's program, through the development
of:
(a) finishing ponds, to polish or eliminate final effluents,
which can be used as well for public angling
(b) reforested areas or areas of natural woodland for spray -
irrigation disposal of secondary effluents
9. Request the Ontario Department of Municipal Affairs outside the
Metropolitan Toronto Planning Area and the Metropolitan Toronto
Planning Board inside the Planning Area to provide the Metropolitan
Toronto and Region Conservation Authority with the opportunity of
commenting on subdivision plans with respect to sewage disposal as
it may affect schemes undertaken or to be carried out by the Authority.
10. Develop sewage treatment facilities in the Conservation Areas
using:
(a) wherever possible, within each heavily used Area, a
decentralized system of several septic tank and tile
field installations
(b) where a high- capacity installation is required in any
location within an Area, a conventional or total re-
tention lagoon, or a package plant with irrigation,
ponding or tile -bed disposal of the secondary effluent
11. Plan swimming areas in reservoirs in locations determined by flowage
and water quality studies to be the best sites available; develop the
areas to provide ample water volume in relation to the intensity of use;
and provide a substrate of coarse sand or fine gravel to reduce roiling
of the water in the swimming area;

12. Co- operate with local Health Units in inspecting water
and in studying and implementing on -site water treatment if
quired;
13. Co- operate with local Health Units in locating points of domestic
pollution so that Medical Officers of Health may require offending
homeowners to correct polluting situations;
14. Assist municipalities and the Ontario Water Resources Commission
in detecting the entry of trade wastes into water courses on its
monthly checks on the river valleys;
15. Continue its program of streambank erosion control in upstream
Conservation Authority lands and other valley lands in co- operation
with local municipalities, expand streambank erosion control as an
assistance program available to private landowners above reservoir
sites and encourage farmers to protact streams and their banks from
damage by cattle through the development of by -pass ponds and gravelled
and fenced crossing and watering areas.

The Flood Control and ?later Conservation Advisory Board met jointly
with the Humber Valley Advisory Board at the Authority Offices, #7
Highway, on Thursday, October 3rd, 1963, commencing at 10:00 a.m.
The first portion of the Meeting took the form of a tour of current
Flood Control Projects, and a luncheon.

PRELIMINARY ENGINEERING STUDY - EBENEZER DAM & RESERVOIR
Mr. Fennerty of James F. MacLaren Limited, Consulting Engineers,
presented the preliminary engineering study of the Ebenezer Reservoir.
The project was studied in considerable detail.

Authorities Branch, Ontario Department of Lands and
Forests for approval;
No further action be taken in connection with the Ebenezer
Reservoir, excepting land acquisition, pending completion
of the revised Project Scheduling for the Authority's Plan
for Flood Control and Water Conservation;
(c) The Staff be authorized to negotiate with the Municipalities

Mr. Fennerty of James F. MacLaren Limited, Consulting Engineers,
presented the preliminary engineering study of measures required for
flood control on the Main and East Branches of the Humber River.

(a) Copies of this report be forwarded to the Conservation
Authorities Branch, Ontario Department of Lands and
Forests for approval;
(b) The Staff be authorized to negotiate with the municipal-

PRELIMINARY ENGINEERING STUDY - MILNE DAM AND RESERVOIR
R.V. Anderson and Associates Limited presented a preliminary engineer-
ing report for the Milne Dam and Reservoir.

THE BOARD RECOMMENDS THAT: The preliminary engineering report on the
Milne Dam and Reservoir, as prepared by R.V. Anderson and Associates
Limited, be approved in principle;
AND FURTHER THAT the following action be taken:
(a) Copies of this report be forwarded to the Conservation
Authorities Branch, Ontario Department of Lands and
Forests for approval;
(b) Provision be made in the 1964 Budget Estimates for the
final design of the Milne Dam and Reservoir;
(c) Site IC/ as recommended in the report be confirmed;
(d) The dam incorporate an Ogee type spillway with a low
level discharge;
(e) In the preparation of the final design, consideration
be given to the possibility of raising the permanent
water level by two feet;
(f) In the preparation of the final design, a review be
made of the hydrology before a final decision is made
regarding spillway capacity.
PROPOSED REVISED FILL REGULATIONS
Mr. Sutter presented a brief Progress Report on the proposed revised
fill regulations, and advised that at the next meeting of the Board
would hope to have a final draft.

MIMICO CREEK WATERSHED STUDY - Presentation of Report
Representatives of H.G. Acres and Company Limited, Consulting Engineers,
presented a preliminary engineering report - a study of the Mimico
Creek Watershed.

THE BOARD RECOMMENDS THAT: The preliminary engineering report, "A
Study of the Mimico Creek :atershed", as prepared by H.G. Acres and
Company Limited, be approved in principle, and that.the following
action be taken in this regard:
(a) Copies of this report be forwarded to the Conservation Authorities
Branch, Ontario Department of Lands and Forests for approval;

(b) Copies of this report be made available to the Municipalities of
Toronto Township and Metropolitan Toronto for their consideration;
(c) With regard to the specific recommendations contained in this
report, the following policy be adopted:
i) The hydrology be reviewed in detail for individual
projects as they are undertaken, in order to take
advantage of additional data which will become
available;
ii) The staff be instructed to strictly enforce any and
all Authority Regulations relating to the dumping of
fill or erection of structures within estimated
flood lines as shown on Plates 11 to 24;
iii) Before local channel improvement works are undertaken
in the Queensway area, that further study be given
the economic feasibility or the desirability of ac-
quiring the lands and removing the buildings consider-
ed to be flood vulnerable;
iv) Before channel improvement works are undertaken in
the vicinity of Dundas Street, the Consultant be re-
quested to advise the Authority whether or not some
alternative structure might be employed which, while
adequate, would be less costly;
v) The channel improvement works for the Royal York Road
area and the Village of Malton be undertaken as re-
commended;
vi) The recommended channel improvement in the Disco Road
area, while necessary, be considered to have a low
priority;
vii) Flood control by means of reservoir for the Mimico
Creek Watershed be ruled out as economically un-
feasible;
viii) No further consideration be given to the suggested
diversion of the flow from the Humber River;
(d) A program of flood control for the Mimico Creek Watershed be under-
taken, on the basis of the findings of the Acres Study, as funds
can be made available.

The Staff presented a preliminary report on the Snelgrove Dam and Re-
servoir, prepared by M.M. Dillon & Company Limited, Consulting
Engineers.

ETOBICOKE RIVER - WATERSHED - FURTHER STUDY
A Staff communication was presented, reviewing various problems arising
in the Etobicoke River Watershed. The matter was discussed at some
length.

THE BOARD RECOMMENDS THAT: A proposal be invited from the firm of M.
M. Dillon and Company Limited for an overall Preliminary Engineering
Study of the Etobicoke Creek Watershed for flood control and water
conservation purposes; the general terms of reference for such a study
be similar to those of the Acres Study of the Mimico Creek.
Specific terms of reference should include:
(a) a re- appraisal of the Snelgrove site for flood control
purposes only
b a closer examination of the Elm Bank site
c examination of other potential retardation storage sites
d a study of necessary channel improvements and tank stabil-
ization works from Burnhamthorpe Road to Lake Ontario
(e) an examination of possible means of increasing summer flow
as recommended by the Ontario Water Resources Commission
in their study of Peel County;
The Province be requested to make a grant of 75% of the cost of this
Engineering Study.

REGULATIONS - PROPOSED AMENDMENT RE FILL AND STRUCTURES
The staff presented proposed new regulations concerning fill and the
building of structures in accordance with the new legislation passed
at the last sitting of the Legislature. Proposed amended regulations
were considered in detail.

of Lands and Forests, and that he be requested to approve
them;

effect.

C -1U SCHEDULE A
Permissive Legislation
Prior to April 26, 1963 section 20 of the Conserva-
tion Authorities Act permitted an Authority to make
regulations "prohibiting or regulating the construction of
any building or structure, or the placing or dumping of fill
of any kind, or on a pond or swamp or in any area below the
high water mark of a lake, river, creek or stream."
At the present time the Authority has, under the
provisions of this section, regulations prohibiting and regu-
lating the placing or dumping of fill below the high water
mark of the rivers under its jurisdiction. These regulations
have been in effect for approximately 30 months.
As a result of experience gained in the administr-
ation of these regulations it has become apparent there is a
need for effective control over the placing or dumping of
fill, not only below the high water mark of any river, but
also within any portion of the valley systems under the
Authority's jurisdiction, (i.e. anywhere below the upper
edge of the valley).
Accordingly, an amendment to the Conservation
Authorities Act was requested. The requested amendments
have been embodied in Bill 47 which received first reading
February 11, 1963, second reading February 20, 1963, and
third reading April 26, 1963. Under section 4 of Bill 47
legislation now permits an Authority to make regulations
prohibiting the construction of any building or structure
below the high water mark of a lake, river, creek, or stream
as well as enlarging the control over filling to allow an
Authority to make regulations prohibiting or regulating the
placing or dumping of fill in any "defined part of the area
over which the Authority has jurisdiction in which, in the
opinion of the Authority, the control of flooding or
pollution or the conservation of land may be affected by the
placing or dumping of fill."
In addition, the amendments in Bill 47 also provide
permissive legislation allowing a magistrate to order the
removal of fill and any buildings in addition to any other
penalties provided by law, in the case of a conviction. This
court authority provides the real 'teeth' for the said
regulations.
Present Status of MTRCA Fill Regulations
At the present time the Authority's Fill Regulations
now in effect, are still a. initially constituted in 1960
under the original permissive legislation. These regulations
provide for control of fill below the high water mark of
rivers under MTRCA control.
New Regulations
Since the passing of Bill 47 the staff, the Authority
Solicitor, and the Registrar of Regulations for the Province,
have been engaged in the preparation of new regulations in
order to take full advantage of the control now offered by the
amendments embodied in Bill 47. After many revisions, the
following set of regulations was crystalized and agreed upon.

FILL AND CONSTRUCTION

1. In this Regulation,
(a) "Authority'' means The Metropolitan Toronto and
Region Conservation Authority;
(b) "building" or "structure" means building or
structure of any kind;
(c) "fill" means fill of any kind.
2. The areas defined in the Schedule are designated as
areas in which, in the opinion of the Authority, the control
of flooding or pollution or the conservation of land may be
affected by the placing or dumping of fill.
3. Subject to section 4, no person shall
(a) construct any building or structure or permit
any building or structure to be constructed in
or on a pond or swamp or in any area below the
high -water mark of a lake, river, creek or
stream; or
(b) place or dump fill or permit fill to be placed or
dumped in the area designated in the Schedule.
4. Subject to The Ontario Water Resources Commission Act
or to any private interest, the Authority may permit in
writing the construction of any building or structure or the
placing or dumping of fill in any area to which section 3
applies, if in the opinion of the Authority the site of the
building or structure or dumping and the method of the
construction or dumping would not affect the control of
flooding or pollution or the conservation of land.
5. No person shall begin to construct any building or
structure or dump or place fill in any area to which section 3
applies before the permission reauired by section 4 has been
obtained.
6. (1) A signed application for permission to construct a
building or structure shall be filed with the Authority and
shall include,
(a) four copies of a plan of the property showing the
proposed location of the building or structure, its
elevation, and the proposed final grade plan;
(b) four copies of a complete description of the type
of building or structure to be constructed,
including drainage details;
(c) four copies of a statement of the dates between
which the construction will he carried out; and
(d) four copies of a statement of the proposed use of
the building or structure following completion of
the construction.
(2) A signed application for permission to place or dump
fill shall be filed with the Authority and shall include,
(a) three copies of a plan of the property on which
the fill is to be placed, showing the proposed
location of filling, the depth to which it is
proposed to fill and the proposed final grade of
the land when filling is completed;
(b) two copies of a complete description of the type
of fill proposed to be placed or dumped;
(c) two copies of a statement of the dates between
which the placing or dumping will be carried out; and
(d) two copies of a statement of the proposed use of
the land following completion of placing or dumping.
7. The Authority may, at any time, withdraw any permission
given under section 4, if in the opinion of the Authority, the
representations contained in the application for the permission
and amendments thereto are not carried out.
